The Supreme Court of Canada unanimously ruled Thursday that police can sift through garbage if it has been set out at the edge of your property for municipal collection because "abandoned" goods do not trigger Charter of Rights and Freedoms protection.

The decision rejected Calgarian Russell Patrick's quest to overturn his drug conviction on grounds that police violated his right against unreasonable search and seizure when they snatched four bags of rubbish, compiling enough evidence to obtain a search warrant for his home, and then charged him with trafficking ecstasy.

The trash, which contained such things as drug recipes and receipts from manufacturing supplies, was contained in an open receptacle at the back of his property adjacent to an alley.

I always thought that garbage had no rights.

Well, now I know its true.

Poor garbage.... and yes leaving drunk hookers on the side of the road means you can do what you want with them now. 😉
 
Makes sense, if you're throwing it out anyway you're assuming animals as well as people could potentially get into it. For the stuff you don't want others to see, that's what termite and/or a paper shredder is for. :d

the first I heard of it was during the 1st season of Law & Order. The ADA said garbage does have rights in certain circumstances and he (Robinet) has to check it out to make sure.

Garbage have no rights, but dumpster diving is illegal.

I never really understood that, same with salvaging from the dump. To me they should allow it and just make it clear that it's at your own risk. Someone else's garbage is someone's treasure. 😛
