It comes down to accuracy and reliability..... how can the trackers assure that the IP addresses they collected are verifyable.... and will not accidentally point to the wrong person.... will their record hold up to the same scrutiny given to evidence collected for example in a criminal case by the police....
And in this case the judge said no...

Actually the judge based his decision on the previous court rulling that it is legal to download copyrighted stuff but illegal to upload it. This judge used that decision as a guide to decide whether someone was uploading without consent things that were copyrighted. It had diddly to do with IPs or nicknames on Kazaa.
