Can you sell items on ebay if you dont have them in your possession?

Been waiting on some items for over 2 weeks now (LINK)....

FINALLY got an email back tonight....

Hi,

Sorry for the delay, because this shipment of the SANYO 5300 SCP-5300 LCD
DESKTOP TWIN CHARGER is waiting to check from the custom service, it will
arrive to me by next week. Sorry for the inconvenience.

Next week?! That means i wouldnt get it for another week or so after that.... A freakin month after i ordered the item....

I wrote back requesting a FULL refund back to my paypal account....

My question is..... Can you sell items on ebay that you dont have in your possession?

I believe you can. My friend wanted to buy a laptop that the guy ordered from Apple at wholesale, and his auction didn't get closed and it was specifically listed that he didn't have it yet.

It's probably not a good idea in general, but sh|t happens.
The seller could have had a ship date and then it got delayed (like many people here have complained about Dell).
Now is sounds like it's held up in customs.

Personally, I would be disappointed but not real pissed unless it was something I really needed right away.

I've used plenty of cheap chargers in all my phones, never had a single problem.....

BTW, the "real" sanyo desktop charger costs $99. No way in HELL am i paying that much for a piece of plastic...

No... you're not allowed to... does that mean you can't? No... but it's against eBay's policies.
I'd provide a link, but I can't see to find where I've seen that. I know I've read it though.

I know. I've been tempted to buy one. But I'll prolly run out and get a 6400 this week since you can get them for $50 now. Anyway, I attribute a ruined OEM Motorola battery to a cheap desktop charger. I'll stick to OEM chargers from now on.

if it is a preorder (item must ship within 30 days) then you can list the item but they should have listed that it was a preorder

If it was an item that is part of a wholesale order - then i think waiting is fine.... else it shouldn't take anytime more than 2 weeks to deliver anything unless it's insanely huge/heavy. Read the fine print if there is - usually people say when the items will be shipped; at least I do when I say I'll ship 24 hours within payment.

I can't stand ebay experiences sometimes - some of them shoudl really be screwed *rant* - sorry about that :p

"All shipments are made via United States Postal Service either by regular airmail (3-5 days) or Priority Mail (2-3 days) with delivery confirmation, depending on the types of products purchased. A majority of our orders will be shipped by USPS within 2 business days (mostly within 24hrs)."

He is required to give you a refund.
He can sell the item if he can reasonably expect it to be in stock by the time the money changes hands, but he must notify you of a delay immediately (which he did, it seems) and offer you a refund if you do not consent to the delay (which he did not, it seems).

Oh, and if he didn't notify you of the delay within the 48 hours promised for "most items," he is in violation.
 

Pre-Sale Listings

Pre-sale Listings are those that advertise the sale of items that are not in the control or possession of the seller at the time of the listing. These listings generally consist of items that are sold in advance of a delivery date to the general public.

eBay does permit pre-sales on a limited basis, as long as the seller guarantees that the item will be available for shipping within 30 days from the date of purchase (i.e., the day the listing ends or the date the item is purchased from a store front listing).

A seller who lists a pre-sale item on eBay must clearly indicate within the listing the fact that the item is a pre-sale item and a delivery date that indicates the item will be shipped by the 30th day from the end date of the listing. Additionally, this text must be HTML font size 3 (at a minimum). eBay will end any listing that is a pre-sale which does not include this information.

Such a policy ensures that bidders can pay for an item and still have the option to use eBay's feedback system, Fraud Protection Program and other protections.

eBay, at it's discretion, for special promotional events, may approve a 1st party manufacturer to sell an item outside of the 30-day pre-sale guideline so long as the first-party manufacturer is supplying the actual item for sale. These exceptions will be made for certain promotions and must be approved prior to listing items for sale on eBay that fit the exception above.

You better hurry and file a claim with paypal because 30 days is all they give you. Just claim non-shipment of goods and you'll get the money back.
