Your agreement with Visa/MC/Amex/Novus will prohibit you from charging a convenience fee. Period.

As long as the company can rationalize it and basically swear that the "convenience fee" isn't because of the back-end fees from the CC cos, they can do it, and lots of businesses indeed do that, legally.

$2,000 purchase would normally net you 2,000 airlines miles. I'd gladly pay a $40 convenience fee to use my cc and earn 2,000 miles.
