Can you ask an interviewee if they have ADHD?

I didn't ask, but an interviewee volunteered that she had ADHD.

Legally, can you raise this question in an interview?

You can ask, BUT you can not hold it against them UNLESS it would cost a substantial amount of money to accommodate them.
Even the government asks about disabilities, BUT you don?t have to answer it.

So yes you can ask, but be prepared to be sued if they say they have XYZ and they can prove that is a reason why you did not hire them.

I have been diagnosed and I have not brought it up in past interviews. However, I was going to bring it up with I was interviewed and almost hired to become a federal employee through the airport security thing.

If I remember correctly, the from you fill out for federal employment says that you don't have to say whether you have a disability or not.

Honestly It is a pretty worthless question since ADHD is so overdiagnosed they could tell you they have it and just be have something else

Not to mention it is an invasion of privacy. It is ethically crossing the line in my book.

why would someone want to volunteer that information anyways? most places dont require that you disclose that kind of information.

TSA employee is one thing..but if its just some office desk type job i dont think it would be so bad.

I remember a while back in one of me employment law clases, reading about hiring people with disabilities. Sears does quite a bit to hire "differently abled" people. You know what their average cost of accomodation was? 90 bucks. And you know how much they are repayed in employee loyalty?

i tend to be suspicious of anyone that brings up stuff like that without being prompted.

The thing is that I take Adderall for my ADD. Therefore when I take a piss test they're going to ask what I have amphetamines in my system for. Thus I would have to disclose that I take it for ADD.

thats the thing. at what point do I start to fear interviewing someone with a disability? As a businessmen on a tight budget, I can't afford to take many chances. I don't mean to be discriminatory, but I can't make everybody happy. If I come across two equal candidates, but one has a disability that could possibly effect their performance, shouldn't I have the right to choose the candidate the poses the least amount of risk?

Really? Is that how you see everyone with ADD? That really isn't how it works. I do fine at my job right now. I've done fine at all my past jobs. I've never messed up due to my ADD. To generalize and stereotype like that is wrong. I'm glad I'll never have to work for someone with your mentality.
