Just read about the feds challenging the AZ law. For the sake of argument, lets assume that the law in AZ is struck down because it discriminates against criminals (yes, I know I loaded that one, but it's my thread so I get the first troll). Can AZ sue the Fed's for not protecting the boarders? And if so, why hasn't every border state done it?

I'm sure that attempting to sue the federal government in the federal government's court wouldn't accomplish anything other than wasting more taxpayer dollars.

About all they can do is secede. It sounds like there are people on both sides who would want that.

No, that idea was more or less abandoned by much smarter people than yourself in the early 19th century.

States sue the federal govt quite often. I was involved in a case where a number of states joined a lawsuit against the federal government and won. It happens all the time for various reasons.

Maybe it's because they jump in front of the line, while millions of legal applicants wait for a green card?
Maybe it's because on average they consume more from american society than they contribute in taxes?

And to the OP: I think it might be a stretch. They can definitely sue, but to win the state will probably have to prove that federal government is purposely letting the illegals in.

Last diversion: In English, oddly enough, one does not "load" loaded questions. It's a slight distinction, to be sure, but you'd think we stalwart native defenders of our realm would all know this, no?

Finally, yeah, we do have an illegal immigration problem. They come for the jobs, jobs they are willing to risk their lives and life savings to a coyote to reach, jobs, by and large, that we natives won't or can't take.

Cutting off the SOURCE of these jobs by punishing the knowing or lax employers is one Arizonan initiative I wholly support.

its too hard to go after the employers though. it would require spying on each business regularly to make sure everyone working is legal. very much like health insurance fraud, of course you have to have laws against it but in reality its not enforceable on the broad scale.

it sounds like part of the problem is that getting citizenship is so much harder now that its just worth the risk of doing it illegally... and that is a very sad thought. we are supposed to welcome anyone who wants to come here, not act like were a special tree fort club.

I would agree with this if we didn't have all these entitlement programs. As soon as you start giving away free stuff - you have to start limiting who can get it.

I'm an immigrant, with papers. I married a woman of Hispanic decent, also with papers.

Here in the land of fruits and nuts, they have gone after employers of illegals. In my business, the fine is 25k if caught, I assume that applies to every business, but I have no evidence of that.
Strictly going after employers isn't going to work, the state is more than happy to give illegals a host of assistance programs, so they really don't need to work.

As has been said, states sue the Federal Government very often. There isn't really any such thing as "the federal government's court." The SCOTUS is supposed to be impartial; its duty is to make decisions based on the constitution, laws, and previous precedents. It often makes decisions that the executive and/or legislative branches don't agree with.
