Can terrorists get a fair trial?

The story this morning about the Spanish (or anyone in the EU) not extraditing the suspected terrorists to the US because of the death penalty kinda got me thinking. Can the terrorists get a fair trial? I mean trials get moved to different locations all the time because of too much publicity, etc. Now don't get me wrong, I want to see these guys brought to justice and I am pro death penalty. Should we make a deal with Spain? Tony Blair has said he would extradite anyone the Brits caught, death penalty or not. What do you guys think?
(Secondary goal here is for me to get through an entire thread without calling anyone a nasty name.)

Definetly not in the US and probably not in most countries in Europe. The only place I can think of is in Hague, the international court there. There should all international criminals be trailed.

Military Tribunal Trial. You think that's fair? Nothing is fair in this world. The only thing that's fair in the end is the persons smart enough to get away with it.

Fair to who? The American people or themselves?

The answer is no. No matter what happens, it will not be fair to the American people. This is why they should be shot on the spot. On second thought, that would be too humane for the bastards.

As I understand it now, the British government has said they would only extradite to the US if they were guaranteed not to face the death penalty.

Unfortunately, that would never fly because the vast majority of people in the U.S. support the death penalty, and the international community has been too touchy feely with itself over the death penalty. Sure, they can get a fair trial. Just move it somewhere but New York, Washington or Pennsylvannia, then screen the jurors so nobody serves who actually knew someone that was killed or injured.

What is so difficult about giving the jury instructions like "Despite what you might have heard, these people may not be guilty of the crimes they're being accused of. Its your job to determine whether they are guilty or not guilty. We don't want innocent people to be convicted, nor the guilty to go free."

We're really just saying that people are too stupid to understand or be trusted with such an important but simple task.

Theres no way they'll get a fair trial in america. If they were found not guilty there would be riots on a scale we probably couldnt concieve of.

They really should just be shot on the spot.

In the US, no. Do i care, hell no.

If they were just shot in the head, it still wouldn't be fair to the Americans. So why the hell do they deserve any fairness, when they are known to be guilty, and they aren't even citizens.(well most, but if you are a terrorist, i wouldn't consider you a citizen)

Please. THAT element of America is not represented here. Americans would take to the streets and shoot the bastards for trying to riot. "I'm pissed, so I'm going to destroy and loot my own neighborhood damnit!" This particular incident doesn't cater to that portion of our population. And if they want to burn down their own slums, they should be deported to Uganda or Rowanda so they act like spear chuckers.

I guess my biggest concern would be that we throw away our normal way of doing things (due process, etc) in order to extract some justice. I know these people weren't being fair when they did what they did. However we gave McVeigh a fair trial, Walker, Ames, etc. I am just concerned that we would let our emotions deter us from letting what I think is the best system of justice (although imperfect) run its normal course.

I'm sorry, but I believe they do not deserve a "fair trial". In this case, it should be an eye for an eye. These people hollering about their rights, need to shut the fsck up, and and ask what happened to the rights to live, of the people who were taken down on Sept. 11th and other times?
