this is a far shot, but i thought someone out there might have some advice.

i just started a job 4 months ago (just graduated in june, too). in the last week, my boss has changed my hours twice without discussing it with me. i used to work 9-5:30, but it was changed to 930-6 last week. Now she tells me today that she wants me to come in 10-6 mondays and frindays and 8-4 tuesday through thursday. this is going to mess with my body's schedule and make me very irate... not to mention working late on fridays kinda sucks.

what can/should i do? i'm not sure of my rights as an employee. :( thanks so much in advance!

She's your boss.

She can assign any hours to you she wants.

No they can't just continually shift your hours around. They have to give you a set schedule and stick to it for a certain period of time. In fact there have been several lawsuits filed for that type on behavior. Not sure of the laws or cases right now. I will try to call my father tomorrow and get you some info. He was involved in a case like this twice, once in the 70's, then again in the early 80's. Both times the employer got slammed down hard for pulling this crap.

SPeak with someone else in the company you can trust. Personally, I would try and change those times. Mondays - I hate, Fridays - YOu should be out having fun!

Geeze, get over youself. YOu come in an hour later and go home 30 minutes later or come in an hour early and leave an hour and a half earlier - it's not that big of a change. If that messes you up, I'd hate to see you when you start working salary and work more than 50 hours a week.

Yes your boss can do this, it's their FREAKING JOB you slacker. I feel sorry for her because she has someone as dumb and selfish as you in her workforce.

shiner, thanks! it gives me a little hope. my boss knows she has all of us under her thumb because it's so hard to find another job a.t.m.

i signed on to photograph and catalog new items in our online store. since then, i also have become the webmaster and the marketing department. haha.

the boss is the boss and the employee is the employee. Toying with your hours is well within the bosses rights. Unless you are necessary and crucial to their business, watch your ass get unemployed as soon as u slap a lawsuit.

and for the other comment, WHAT LAW??? the employee-tells-the-boss-how-to-run-the-business-law?

As long as you have something like a 48 hours notice of a schedule change its within their rights

I don't know off the top of my head...I will have to call my Dad tomorrow and see if I can get the info from him. He worked for the USPS and they did this twice before he became a salaried employee. They kept shifting hours on an almost daily basis. Would tell someone that normally worked midnights that oh by the way the needed to work the evening shift after they went home that morning and got a few hours of sleep. Basically they just keep fvcking with people's hours and it was going on nation wide. There was a lawsuit, the employees won, and the USPS had to pay some enornous amount of money, into the hundreds of millions, in back wages, overtime, time & 1/2, and in fines. About 5 years later they turned around, did the same thing, got sued, lost, and had to pay out a bunch of $ all over again.

That is not correct, at least not any more. All that is required is 8 hours between shifts. That is it. No set schedule at all is required. I used to open some days during the wek at work (4:00 am) and close other days. (1:00 am leaving) all in the same week.

8 hours is all that is required by federal law (unless it is a agracultural enviroment where exceptions are made) States are of course allowed to make more scrict rules, but the Feds (and IL) is 8 hours between shifts. end of story.

They do have to provide notification of any changed shifts at least 48 hours in advance of the change. (at least in IL) not sure about Fed on that one.

Also, if you work more than 6 days in a row, and the 7th is on a Sunday (or anything after 6 is a sunday) then you get double time for that sunday. (Not sure if it is double time for everything after that sunday or not.) again, this rule can be broken in agracultural enviroments.

everything I say is based on IL law, and some issues I had with my past employer, so they were law as of late 2001.

i probably have no ground then. she gives me notice when i come in during the day and says it goes into effect the next day. i guess that's enough notice.. and the hours aren't too crazy like working graveyard shift then work the morning shift or something. i will just chalk it up to a lesson learned.

thats totally diff case, I think by law, your employer has to give you 8-10hrs break between 2 shifts.

Interesting...sounds like things changed since my Dad was involved with those lawsuits. Of course it was 20+ years ago. I've always been on salary so I'm used to working long hours without extra pay....especially now that I'm in a management position.

Then here is a law you may need at some time. If you are EVER docked in pay for ANY REASON by law, you are no longer exempt, and the company must then pay you for all the unpaid overtime you worked for since you became salaried. (backpay) They may not dock you a day's pay, or even $5 for losing a time card.

They may however dock you a weeks pay, and not have you come in. Basicly they can force you to take an unpaid leave. They can not force you to do this for anything less than a week though, or the above rule applies.

this is FEDERAL law. it is valid in every state :) Just in case someone got screwed, and wants to make their company pay out the nose. That is what they get for forcing people to work unpaid :)
