Can I sue a big corporation in small claims court?

Yeah....why don't you get your insurance involved on it? They can be the ones that sue Acura instead....

I like that idea too, but if you wish to sue, just be aware that their lawyers may file a motion to get it pushed out of small claims court so they can represent their client. Then you'll need to pay for a lawyer too.

I was in a situation that was somewhat similar to this. My car was towed with damages and the towing company told me to call them to get it fixed. I called and called and called (and left messages etc) and I didn't get any response. After about 2 months of run-around, the best piece of advice i can give to you is to call your insurance company and tell them to handle it for you.

WRONG!!!!!!! Factory bumpers do not come painted. They are all paint to match.

BTW, it may be easier to turn a claim in to your insurance company and let them subrogate. They will be relentless in the pursuit of getting their money back.

You should be able to get this covered under your comprehensive since it is not a collision... Check it out, this will be by far the easiest way to get your car repaired and let your insurance company lawyers handle hunting down the culprit.

Its gonna be tough since you have NO proof and its your word against theirs.
Its $40 to file but don't forget court cost...if you lose you pay that....around $200 maybe ??

You can sue Acura. The fact that their principal place of business is in CA is not relevant. If they are doing business in your state, then you can sue them. What's confusing is that you say that "Acura roadside assistance tows my car" and later, you state that "neither Acura roadside, the tow company or the dealer will fess up." Was Acura roadside the tower or was there another tow company other than Acura?

You're going to have to name Acura roadside and the dealer - and the tow company if it's not "Acura roadside" - as defendants. Make sure you pick the correct small claims court for jurisdictional purposes. Speak to a clerk in the small claims court. They can be pretty helpful sometimes. If both (or all 3) are under Acura's control, then try the small claims court where the dealership is located.
