Can I legally sell an opened win 7 pro upgrade?

Not surprisingly, I ordered the wrong version of win 7. I need the win 7 pro full. I have already opened the package and tried to install it on a ssd. I did not have xp installed before, so it won't activate online. I don't think newegg will let me return it, can I legally sell it?
 
If you had any Windows OS (newer than XP) installed on the machine in question before, then Microsoft officially supports the double install method using Upgrade product key, or you can give them a call and they will get you properly activated on the phone.

If retail upgrade key is not currently activated on any other machine then it is very much legal to resell it to another person.
 
You can sell an opened "Retail" Windows package as long as it's not being used on another PC. You can't sell an opened OEM Windows package except when it's been installed on a PC and it's being sold along with that PC.
 
can you give away a NFR (Won in contest) windows 7 Ultimate (key and disk that says not for resale) with purchase of a computer? Yes it was really won. contest.
 
Yes, you can give away a Windows NFR copy. You're not supposed to sell it. To quote what an MS employee told me once, "You can do anything you want with it, but we don't want to see it on an invoice."
 
Just install it, good chance it will install no problem. I've put the upgrade on 3 machines here, 2 on blank HD's, only one needed a reg entry as outline on MS partner Thurrott's Winsupersite site.....
