my husband was hired 2 years ago at a company. He was arrested 2 weeks after he was hired, he never told his employer. To date he has not gone to trial and has not been convicted of anything. Yesterday his employer notified him that they were doing an investigation into this and suspended him until further notice. We are not sure how they found out, maybe just decided to do a background check after 2 years. Can they legally fire him for this? He did not lie on his application and the arrest has nothing to do with his employer or his job performance.

Check with the laws in your state. Here you can be fired without cause at all just well... because and you have no recourse to challenge other than through your upcoming Unemployment hearing.
In Maryland the only law is that you cannot be fired for protected reasons (race, religion, age, gay). But even then as long as the boss doesn't send out a memo announcing he's firing all the black people today or something, good luck proving that. Again, they don't have to give any reason or even formally notify you. They can just change the locks after you go home, mail your last check, and you're done. It's called "at will" employment, and the will is not yours.
