Can I call my CC about this?

I bought the MSI 6800GT doom3 bundle way back in August when it first showed up on site. I finally received the card around the 20th of September and it did not include Doom3.

Going to MSI's site doom3 is not bundled, nor is the MSI card in the doom3 promo that other manufacturers were in. This would mean that Doom3 would have had to ship in it's own seperate box. I am not the only one who did not receive doom3, there are two other people on this board that did not receive it either. Buy.com STILL has the bundle on site when it's obvious that the game isn't included - it would have to be a completely seperate box.

I submitted a claim to buy.com on Sept 21 and it says 15 business days to respond. That deadline passed last Tuesday, I called them and asked for a $50 credit or the game and got some person in India who had no clue what to do but told me that they would resubmit the claim and I would receive a response in 5 days, that would have been today.

I am going to call tomorrow but I know nothing will come of it, I am now wondering what are my options? I do not want to return the card, and buy.com is not being cooperative. Can I call my CC company to refute the charge? Can I just refute $50 (the value of doom3 on buy.com's site)? Or can I have them refuse the entire charge? I have MBNA Platinum Plus Mastercard that I used to purchase. Anyone have any tips or know what to do in this situation?

Cliffs notes:
1. Bought 6800gt from buy.com with doom3 bundle did not receive doom
2. Buy.com has ignored my complaint request and the deadline has long passed for a response from them
3. Want to know what I can do. Call CC and refute charge? Refute $50?

Any help is appreciated. Thanks.

You would have to prove that doom3 was sopposed to be bundled with it. But i'm not sure what the CC will do. you did get what you ordered.
 
Yeah call the CC company--can't hurt at least. I have AMEX, so I've only dealt with them but they were great when Office Depot basically wouldn't refund my money on a shipment that was refused and I had called like 5x.

No he didn't. He ordered a 6800GT bundled with DOOM3, he only got the 6800GT. He didn't get everything he ordered, only part of it.

I guess he did. Usually they have it if you purchase XX then get XXX for free (if supplies last) but i didnt see that on this.

Anyways, I'm not gonna bash on this guys thread.

As to what he should do. I don't know. Best option would be to cancel the payment, wait to see what buy.com says. But you'd probably have to end up returning the card. Otherwise, keep arguing with buy.com till you get the game.
 
most credit card companies only let you dispute a charge for 60 days, so if you placed the order in August you'd better get on the ball.

eh? no you will not get the card for free and there is NO reason for you to. At most they will refund part of the money. But then again most have a $50 part that you have to pay.

I would continue calling (do not email) and talk to managment etc. You should get the game if you keep it up.

 
Don't want it for free, just want the game or the credit. I *would* talk to management, but 1. They are in India and it'll probably be hell getting to a US person 2. The thirty days to file a claim with my CC ends Thurs.
