Can I arrest anyone who I deem to be causing trouble?

Citizen's Arrest


Partly, in related to the Police Beating ...

Can I arrest a police officer (or someone) who is drunk and trying to caus trouble? How can I first arrest him/her...assuming i dont really carry handcuffs in my back pocket.

Then, say I have him/her tied up or something, what do I do....take the person to the police station?

Not that I would win in any fight: a small regularly weighed indian guy gives you the idea. But say I got jacked and can overpower some drunkard or high individual looking for trouble, What are my rights...can any legal action be brought against me? I am guessing not, since there are likely witnesses (otherwsie, i would just beat him up, and rest would be hear-say).

EDIT:: Point is ASSUMING I can overcome the person physically....so lets leave "you will get ur ass kicked or shot" out of it...

EDIT2:: COP isnt the real issue... I am talking about just generally...and possibly including an off duty cop who is wasted

I would definitely if I could...that would justify it totally, and I would be free of any possible charges.

I am not saying I would do it randomly for no reason. Only when its obviously needed... like that police officer beating up the bartender.. I try to save her, and arrest him in the process.

The only thing is the backlash... police officers are like a legalized gang, because they think they have too much control.

Not if you knock him out straight away, but I wouldn't try to 'arrest' him - what are you gonna do then? Take him to a police station? LOL. That would be a quick shortcut to the hospital.

LOL, yeah, possibly. But say I get witnesses to come with me and make sure I collect evidence at that point.

I am considering the ideal case...

But, lets just say its an individual, NOT a police officer for now...
 
I wouldnt risk getting my ass kicked making a citizens arrest. However, one of my good friends that used to work at Office Max chased a Mexican that had stolen something into the parking lot, and tackled him. After throwing him to the ground, he yelled "Citizens Arrest BIATCH!!". I lol'd on that one.
 
you better hope everyone knows what is going on, or i can't be too sure about what will happen when a retired navy seal walking out of the bathroom watches you smash a stool over a cops head.

your friend could've been arrested on assault charges. Once a person is outside the store security can NOT touch them. Won't stop them from trying and hoping the thief doesn't call them on it. There's no legislation in any state or federal law that actually allows for citizen's arrest.

Before you do, make sure you:

1. Put all your belongings in long term storage.
2. Not sign another lease / sell your house.
3. Visit any dying relatives.
4. Not make any short or long term plans.
5. Stock up on lube.

LOL... its just funny how everyone who responded so far crapped their pants just thinking about getting involved with an off duty cop. No wonder they have so much control over you guys... talk about democracy or lack thereof... and why so many police abusings go unnoticed and unanswered.

Anyways...that is NOT the real point... I am just talking about the legality and consequences of making a citizen's arrest on a random individual, not a cop

There's case law all over the place. Citizen's arrest is not a myth. Do you think they abolished it some time after 1965 or something?
