Can an apartment management do this without proof?

We just got an "eviction" letter saying that if we don't stop making so much noise, we will be evicted. Apparantly the eldery woman above us is 350% convinced that we are playing loud rap thumping music all during the night and into the early morning hours keeping her awake. No matter what we said to her, she just argues that it's coming from our apartment. OK so I'm 43 and my BF is 50 and our party days are long since past and we go to bed every night at 11 or earlier! We seldom ever play music and never during the evening or night! She is hearing someone elses music or she is making this up...

How can a landlord do this without some proof? Can they? It is someone else so the noise is going to continue which means she's going to keep complaining about us which means we will be evicted for an apartment we've living in for 10 years!!!!!!!!!!!! Talk about helpless!

Stay up and listen for the music, call the cops, call the landlord and tell them you found the perpetrator and it wasn't you.

They probably can't evict you for not being the person, but it's going to be pretty annoying to have prove it's not you and/or fight that legal battle.

Why should we have to spend money on a lawyer to defend ourself against something that she obviousy doesn't have any proof of...she can't have proof because it's not us! We told her that the next time she hears the loud music to come to our door and hear that it's not us and she flatly refused to do this...we offered her our phone number...she refused this too! And why should we have to stay up nights to try and possibly find out who's doing this...this woman is making false claims against us...isn't there some sort of law against this?

Why don't you simply respond to the apartment management with what you've posted here...
That
a) the lady has complained to you and you've told her before the noise is coming from somewhere else - she's mistaken on which apartment it's coming from
b) You've offered her your phone number or to come to your door to verify it wasn't you. She refused.
c) Your demographic certainly doesn't fit with the rap music that she's listening to.
d) You don't even listen to music at night

Do so politely, with a well worded letter. Request that the management contact you to discuss this matter. And, at the bottom, include cc: your lawyer's name.

You probably won't need a lawyer.What they'll need is proof that you are the culprit and that old trout's word won't be good enough. Also keep communications open with the Management of the property. I seriously doubt they'd want to evict long term tenants who pay on time...unless it's a rent control situation.

Tell you landlord everything you just wrote hear. Any reasonable landlord wouldn't evict a 10 year rent paying tennant for unfounded accusations.

If you pay on time I highly doubt they'll evict you. They're probably hoping that the problem is just going to go away with the sending of a letter. Find the Manager and explain this to him in a calm way. I'm a former property manager, I had this exact problem and sent the accused tennant a copy of their lease with the noise line circled. Turns out it wasn't them, the lady upstairs was nuts. I did not send an eviction notice, that's a little crazy IMO.

We have never been late on one single payment in the 10 years we've been here! The letter says that if we don't stop the noise, we will be evicted. What is scarey is that we have no control over the noise because it's just going to continue. I guess one problem is that the management company is a large corporate company that operates hundreds of complexes! Noone knows anyone personally.

Yes, I believe this lady is nuts too but if they only listen to poor little old granny, how can we get our side in? Ya know, there's enough to worry about in life without something imagined by a crazy old woman to worry about!!!!!:disgust:
