Can a potential employer ask if you are married?

If a woman is married, she may become pregnant. If she becomes pregnant, she will most likely be mising work. Employers want people to work, so they might be less likely to hire someone who is married.
If a man is married, he may need to take time off for his wife's pregnancy.
Or the person may have kids already. That person may want more time off to spend with their kid(s).

I remember talking about this in my business law class a while back. I can't remember if it is specifically illegal or not to ask, but it is illegal to decide who gets hired based off whether or not they are married.

Apprently it is illegal according to RGN's link.

If it comes up in coversation, you probably shouldn't blow up. If I asked someone in an interview, I would just be trying to get to know them and judge their social interaction skills. If someone refused to answer or got litigous, that would be a big red flag.

But the rules may vary from place to place.

And as others have said while it may not be legal technically you might get asked anyway depending on the job interview. Not many would be likely to sue over something like that.
