Can a company legally reduce your pay without telling you?

I had a 3% commission on my sales when I came aboard with this company. I noticed it wasn't included on the check last month, so when I went in to ask about it, payroll cut me a check, then showed me a form, signed by the GM where my 3% commission is "disconitnued" as of 1/1/05

Now, no one told me about this. Not my boss, not his boss, no one. Well, except for the girl in payroll, who wouldn't have even said anything had I not asked for a copy of the form stating that I'm to recieve 3%.

Can a company do this? Just decide "Hey, we're not paying you commission anymore."

It's almsot like they hadn't planned on telling me. According to the sheet, the decision was made on 12/16.

Furthermore, is there anyway I can get them to change their mind?

I suppose the first question is:

Do you have anything in writing from when you started the job that states you are to receive 3%?

That still wouldn't mean you were in the clear but it would mean the company couldn't make these changes without your knowledge beforehand. Unfortunately nothing stops them from telling you ahead of time that they are going to cut your pay and then doing it.

negotiation? you are in sales.

Legally they can start paying you minimum wage and 0% commissions any time they feel like it, just not retroactively [ or before any existing written agreement expires ] .
 
If you do not like your compensation, you are free to leave.

They only have to pay you the minimum wage, unless there is something else written in a contract.

It was improper for them to reduce the pay without notifying you and you may be able to recover up until the point that you complained.
 
Wow, if this happened, I would recommend you politely express your discomfort that they didn't tell you about it, at the least, sooner than you found out. Also, I would immediately start looking for another job. If this is the way they do business, you don't want to be there.
