Calling cops on roommate - would they "remove" him?

We have a deadbeat roommate who's been bouncing checks and not paying for utilities. HE gave us 2 weeks (not a month like he should) that he's moving out - which put us in the awful situation of having to find a replacement very quickly. We luckily did find someone and she paid her deposit and is ready to move in on the first.. This pr*ck, however, hasn't boxed a thing and doesn't seem to be moving out. Honestly, I'm thinking that he's acting without honor or respect in the past so I'm pretty sure that he'll stay past the 31st. The problem is, however, our new roommate has already paid for the month *and* is new to the country and sleeping on a couch.. WE NEED HIM OUT and we're not burly guys. Since he's not on the lease would calling the cops get him immediately removed or do we have to go through the court system?

*UPDATE*
His room has been emptied out, the stuff that he left behind moved to our living room. I was very slick and offered him $50 for his furniture (my new roommate's new to the country and has nothing yet - we saw the same stuff at Ikea today selling for 3 or 4 times that) and he accepted - so Tilly benefitted and we kinda screwed him over for being in a desperate situation that was his doing. It also means that he has less stuff to take out, a win-win situation...He has until monday to take what's left of his personal belongings.

Unfortunately, it'll take the landlord, a formal eviction notice, a court date, and a sheriff to get him out.

Just put some crack in his pocket while he's sleeping and call the cops.

ROFL, it's Dec 30th and he hasn't picked up anything. And he wants to move out tomorrow.

Legally, I believe you can call the cops and have him removed if he no longer lives there. What has he signed for? If he's signed something that has him ending his residence on the 31st, then you should be able to have him removed from the property.

If he is no longer on the lease as of the first, he should be evicted. I'm not sure if you can get him forcefully removed that soon though. You're pretty much screwed on the utilities unless you take it to small claims.

He won't come back and do anything to us.. He was a friend of mine. I'm embarrassed to be in this situation. I'm embarrassed for him... Some people need a swift kick to be set straight and I'm tired of being taken advantage of.. But, yeah, he's not the type to ****** with us and, if he is, i have a desert eagle owning marine cousin who lives 5 minutes away ;)

He actually smokes a lot of weed and does cocaine often enough... His room is probably loaded wiht enough evidence to lock him up overnight..

Definately call the cops on him. It will give you a paper trail and also the cops will give you advice on how to proceed from here. If he's not on the lease, they also might make him leave or charge him with criminal trespass. You might also be able to file a small claims suit to try to get money from him.

haha.. NOTHING.. i dont' speak to him anymore.. Only one person, Nick, is on the lease. The dick told Nick on the CELL PHONE (What a coward!) that he's moving out on the 31st. Nothing was signed.

Tell him he has 12 hours (doesn't matter WHEN you tell him this) to pack his stuff up, elsewise you and the other roommate will take care of it for him by tossing all of his stuff in the dumpster. Change the locks, don't give him a key. If he's still there after midnight on the 31st, physically throw him out of the apartment. As he no longer has a working key, there's not a bloody thing he can do. And no, I'm NOT being the usual AToT asshat - I'm serious. If he no longer lives there, even if the cops won't do anything, he is now tresspassing. If he doesn't have a place to move to at this time, too bad for him. He's had time to get a new place.

Sounds like excellent advice. We also plan on packing up his stuff at 1:00 am and putting it in the hallway. The issue is if he decides to stay in - our new roommate is coming iin at 10 am on the 1st so this could get messy.

If he ends up not leaving right away, I suggest you be nice and let the girl move into your room. You can keep all your stuff in a closet or something and bunk with the loser and take his room when he leaves.

If he isn't on the lease and hasn't paid to be there for the month, then he has no right to be there if you don't want him there. Eviction rules hold no place a person with no contracted claim to a place.

Call the police and ask for their suggestion. If the guy still has all of his crap there but doesn't come around, then just contact him and tell him that if it isn't gone, you're putting it outside on the porch for trash diggers to steal.

If your apartment's dirty, don't call the cops. You will be in just as much trouble as him.

Quick question... I'm not too ashamed to admit that I'm a flabby guy and he's a bit of a muscle builder. My other roommates are gay or female - I'm going to have to make a few phone calls and call in some favors.. but if the cops tell us to take him to court and my buddies "convince" him to move out... Well, could we get in trouble?
