My ex falsely filled a restraining order against me, and I haven?t heard a word from her for over 6 months (only hears from her & my lawyers).

She took my house & now she want to make my life miserable with the RO.

I don?t know what kind of lies & half truth that she painted to get a RO that forbid me from contact my ?ex, family, and friends?. I don?t have any ill feeling nor aggression toward her (I don't have a violent record), and I haven?t contact our mutual friends & family for 6 months. However, I don?t want to have this action hold over my head for the rest of my life.

Can I fight the charge & make her pick up my incurred lawyer fees?

:brokenheart:

Unlikely, as in the court of law, a man is always guilty and a woman is always innocent. That's the way it is.

NoShangriLa, in all honesty, should you really be asking "our" advice or should you try retaining a lawyer to protect your interests?

I got a lawyer, and one of the advice was to let her have the money to make life easier for everyone.

She was the one that walked away from me. I was devastated but now I want to move on with life.

WTF!!!!

If it made life easier for you that'd be one thing, however; in this kind of deal you and your lawyer shouldn't be looking to make it easier on her too.

A restraining order is not that simple to get. What's the rest of the story?

1. get a lawyer
2. its ez as pie for a woman to get a RO.

the judge doesn't want to deny it and then have the woman get killed the next week by the husband. bad press. its generally not a problem anyway unless the two live together like my parents did. man that was fun.

Was it a temp RO or a full one?

If it was a full one just fill a griverance in court against it. Go to the court house and they should be able to tell you how to request a hearing. Also ask for a copy of the RO and why it was granted. It should be public info.

You need to fight this if it is false. When you apply for a job it can and will come up on a background search. I do HR work for the Fed Gov and if this popped up you will probable not get most jobs.

As I recall, he was unmarried - had bought a house with his GF.

If I'm wrong so be it, but I'm remembering that they bought a very expensive home in Canada a couple of years ago (and shaking my head thinking 'yet another unmarried couple buying a house').

It was weird that I got served with a restraining order when I didn't touch a hair on my ex.

I didn't bothered to fight the restraing order at first because my lawyer told me that my ex lawyer screwed up the paper work & the paper that they served me isn't legal because it didn't followed standard procedure. I was wrong to believe that my ex required to reprocess the paper work therefore I would have the chance to tell my side of the story.

It could be a knee jerking reaction that they got from the recent murder suicide that happens only a few block from the court house, and only a few door down from my ex lawyer office.

Her bitchy mom wad the cause of our trouble (her 4 people family moved in with us for 4 months, and they came & visit and didn't leave, they didn't ask us for permission to stay).
