There's a difference between volunteering for a "Motivational Program" and being humiliated in public.
Note that the company dropped it shortly thereafter. This has the earmarks of a "company policy" type of thing that got out of hand over time. This woman was also a longtime employee who probably knew that to refuse was to have a ceiling placed over her chances for future promotion.

Insidious behavior by immature irresponsible upper managers, imo.

 
I think it's a bull type of motivation program by the management, but I think more than a mil is obsurd. I think she should have sued for a years pay or maybe two, found a new job and moved on. Instead she's trying to milk the situation way too much.

SOP (Standard Operating Procedure) in this sort of case is to sue for an amount which brings press coverage and get's the company's attention, then settle for 2/3rds or half without any more exposure (pun) of riskfor the company.
I doubt this will go to trial.
 
Large awards like these are punitive in nature. They deter other companies from allowing sh!t like this from happening.

Also, no way a lawyer would have taken her case had she only gone for 2 years of pay. Were there a cap on these kinds of awards then there wouldn't be lawsuits, and asshole managers who think this stuff is a good idea would just continue on forcing employees to do this stuff.

So, which would you rather have? Managers doing crap like this with impunity? Or lawsuits?

 
While I'm not crazy about lawsuits in general, any management who thought this was a good idea needs to be spanked with a hefty lawsuit. It will certainly motivate them never to do it again. I mean, it's basically just a contest and the winners get to humiliate the losers, but come on, you could see lawsuit written on this thing from a mile away. Very idiotic on the part of management.
 
1. I agree that the practice was absolutely retarded.

2. I do *not* feel that people should have the right to sue because they were em-bare-assed 😛 (pun obviously intended.)

3. Most team-building activities are retarded. Lawsuit I'm waiting to see in the news:
"I felt compelled to go to the paintball team-building activity and was shot in the breast. I'm suing for sexual harrassment."
"The team building exercises are almost always geared toward activities guys dominate in. It makes me feel inferior. I'm suing."
