The patent is for emotes over cell phone. not over computer/internet. Though the internet can extend to cell phones now, so it gets to be pretty blurry. I'm not sure how they would legally go after someone breaching their copyright. I have a feeling prior art could be shown saying that they had no right to the copyright in the first place if push comes to shove in court...
 
of course the patent has limits:

if selected via a dedicated or softkey, would be a breach of the patent

So just type it out by hand, not use a "dedicated or softkey" to do it...

And then tell Cingular to shove it. They weren't even a company when emoticons came about.
