Yeah, I like Bush in general..... but there are TONS of medical malpractice cases that are worth MUCH more than $250,000. Even an injury resulting in DEATH would only be worth $250,000.

Lets say your wife of 20 years needs a root canal. She goes in and the doctor uses too much anastescia causing your wife to lose blood flow to her brain. When she awakes, she is in a vegetable state and will remain that way for the rest of her pitiful life. You are too attatched to her to let her die alone, so you baby her for the rest of your lives. How are you going to afford to care for her? Get a baby sitter? Put her in a hospital? That's not free, and your lost wages are going to probably be the least of your worries. You will probably lose your job and become a bum..... Will $250,000 pay for all that?

I don't think so.

Do you understand English? Did you read the goddam thread, Fool?

Compensatory damages will still apply. Punitive damages will have a limit. If you lose your ability to work due to malpractice, multiply your salary times the number of years you'd have worked and that's what you'll get. But why should you get $20 million on top of that?

$250K is a cap on punitive & pain & suffering damages IIRC. No limits proposed on actual damages, which is what you describe.

I agree with the limits but $250,000 is way too low. Maybe $5,000,000 would me feel better.

A Hypothetical. Your 8 year old child dies at the hands of some medical idiot. What are the damages? Well, here in New York they are about zero. The child has no earnings and therefore no lost wages. Also, why should a rich bitch get a lot more than a poor one. $250,000 for pain & suffering is just too low.

otherwise I agree.
