Brother was in a Car accident

This sucks, he got a new 2003 Accord LX, less than 400 miles on it mostly highway.

It was on a 4 lane road, 2 lanes going one way, 2 going the other. Was a green light for us, we're going straight, than the old hag hits us. I'm guessing we both had green. She says the person next to us stopped and let her pass so we must have had red, I don't know what she's talking about she's just dumb. Maybe he was turning also, but she should have checked. We definately had green also. I'm guessing we both had green, but she turned and we were going straight.

At first she said she didn't say much, but she didn't see we were there. Than when the cop came, she started saying her story, and than says her knee hurts. My brothers says his back and knee hurts, and my right knee and right elbow are really bothering me, but none of us reported anything. Anyway, everyone gave their information, I wonder whats gonna happen. She had an old maxima, and it was hardly messed up. It sucks, the cars never gonna be the same, lots of body work, and the axel is bent. Had to call a tow truck. Damn, this sucks the whole value of the car goes down, can't sell it again for a good price.

How long will it take for the insurance companies to work this out? How much should we have to pay around?

Who got the ticket? You pay nothing if it was her fault. Her insurance pays.

Just be thankful that no one died. If you can walk away from an accident then you should count your blessings.

That being said the old hag will not see a dime of your money assumming you're not at fault, give the insurance company a month or 2 to settle it.

call her insurence company imediatly, you dont want her claiming it was your fault first... also alert your insurence company.

No one got a ticket. Should we go to the hospital and get it checked out, just incase she tries to sue?

We don't know her insurance company, the cop said to call a number in 4-5 days and they'll send us all the information.

1. Glad there were no serious injuries!

2. Your going to the hospital has nothing to do with her suing. Go if YOU want to sue, or really if any of you were hurt enough to require it.

3. 20/20 hindsight and all, but you should have gotten the insurance info from her at the accident. My insurance company sent me a little form to keep in the glovebox, kind of an accident checklist for all the info you should get from the other driver.

4. Little bit of advice, keep a disposable camera in your car and use all the film next time you are involved in an accident. You never know when the pics will be important, especially if the police report has any errors in it.

Damn, should have done things differently. Sucks living in New York. Well, I don't see a point in suing, no ones looking to get rich off of this.

This sound EXACTLY how my accident happened 2 weeks ago. I had a green light, a woman took a left turn infront of me. She didnt say anything to the cop except when she found out she was the one getting a ticket. Then in her broken english claimed she had a green arrow. :disgust:

Uh huh.

Cop cited no one.

Our insurance are still battling it out... as of right now, I am out of $1000 deductible.

Good luck on the insurance :(

Sounds like a mess. Was she turning left or right? Was it at a stop light? As a rule of thumb, if you are turning left you are 100% at fault unless it's at stop light and left turn has the right of way.

maybe i'm losing it, but you can't both have green unless the lights are messed up. well you're going straight so i would say it's her fault.

edit: in nyc there's no right turn on red, so if you had the green, it's her fault.

It sounds very much like your incident Spac3d, and I hope you get that settled soon. Only difference seems to be that she speaks english.

This sounds like totally her fault. You were going straight, she was turning left in front of you and regardless of how she read the traffic and assumed anything, it is her responsibility to yield to oncoming traffic. You should call her insurance co immediately and file the claim. Also make it known that you were going straight and she turned and rammed into you. She screwed up in this instance and it is totally her fault. You clearly had the right of way. Be very careful and admit nothing to ANY insurance company if you want to take to a lawyer. A lot of the worst pain after traffic accidents happens a week later-- you never know. Just don't tell them you're OK because you may be laying in bed unable to work next week. If you need to, go to a dr to get checked out-- might be a good idea anyway. I feel bad for you-- totally sucks when some idiot driver hits you, just happened to me a few months back.. I wish I could have sued their pants not only because it depreciated my vehicle but the amazing amount of time and CRAP I had to go through to get my car fixed was terrible. Record everything you had to do and bill her insurance.

So you were going, straight, she was turning left... you say she has "a green arrow and just the green light"? I am not sure what that means. If she had a green arrow, and you had a green light at the same time, the lights were messed up. Otherwise, if she just had a green light, she is at fault. Not that it matters in your state with it's crazy "no-fault" law designed to protect idiots.

I'm just guessing she has a green light or is seeing things because she said the guy next to us told her to go. What exactly is this crazy no-fault thing?
