I think he is the guy in the black jacket in the beginning who confronted the guy. Maybe got his jacket torn off in the fight, like the rapists shirt got torn up.

Possibly both were drunk, or the girl didn't want to get caught (and was stupid).

Hopefully there were enough eyewitnesses and they all recall and testify to the facts properly.
 
I read the news of chinese.
it saids the rapist harassed the girl in the subway,then trailed the girl to the sparsely populated place and attempted to rape her,the girl struggled for a while and exhausted when the man appeared to stop it.
