Nut Shell - since the Boy Scouts can bar Gay Scout masters and athesists, due to the 1st admendment, Law Schools are permitted to bar the military from being on campus with out having federal funding stopped.

You may think this is fair or not and that can be discussed, but the real question I have is:

If it has been ruled that Law Schools can discrimanate and still recieve federal funding, can the Boy Scouts use government lands that they were permited to use intill backlash casused by the 2000 ruling by the USSC?

What do you mean use government lands ? All kinds of religious groups can use government lands, I hadn't heard the Boy Scouts couldn't ?

I thought the issue was about government funding, or sponsorship.

the boyscouts dont recieve federal funding.

well, that's the point. they used too, and some people think they still should, even though the current Scout leadership has turned into more of a religious organization than it used to be.

And it isn't about just Federal support, all types of government are subject to the same standards as far as religious seperation and discrimination.

Your use of the word "discriminate" is somewhat twisted. Courts have found that it's impermissible for the US government to force law schools' to accept the US government's discrimination against gays. This is a different situation from the Boy Scouts, who are themselves discriminating.

how is the govt discriminating against gays?

you mean dont ask dont tell? Please explain how this is discrimination, since it applies to everyone in the military.

And no, the Boy Scouts never recieved public funding.

When was the last time some one got kicked out of the military because it became know he is straight and when was the last time a person was kicked out of the military because it became know he is gay?

Do you really believe that the Boy Scouts are discriminating? Or isn't the real issue that they would rather keep the issues of sexuality out of an organization designed for young boys, and thus don't allow in those boys who would force sexuality into their organization? Have you ever bothered to consider that? That all the Boy Scouts is doing is not letting in 12 year-old boys who have already declared themselves to be homosexual? Or the scoutmasters who will supervise those young boys? And this in an organization that takes young boys out into the wilderness to camp in tents? Is it any wonder that they don't fall so easily for the anti-religion agenda trap to bring them down ala the Catholic church?

Anyway, their organization is private. Any public funds they receive are charitable donations, not actual funding. AA also requires a belief in God, and without courts ordering drunk drivers to go to AA meetings as part of their punishment, the AA would have disappeared a long time ago. Should we attack AA too?

There is a double-standard here. If someone was openly hetero you probably would not deem that sexuality. But with a gay kid or master it's sexuality.

Anyway, their organization is private.
Good. Never said they weren't.

What does this have to do with the current topic?

But then the Boy Scouts isn't co-ed with girls sleeping in those tents, now is it? Or female scoutmasters? The first thing that would happen to the Boy Scouts if it openly tolerated homosexual kids and scoutmasters is that it would be sued out of existence.

AA could not exist without the government support that it receives through the courts. Courts = government too.

You are comparing apples and oranges. One is gender, the other is sexual preference.

How could they be sued for being tolerant?

Okay... I'm not seeing the connection to boy scouts, the military, law schools, and the 1st amendment. Does AA discriminate against gays? If they do, then I guess it's relevant.
