TULSA, Okla. -- A 2-year-old Tulsa boy is dead after a day-care provider bound his hands and covered his mouth with masking tape inside her home-based business, police said.

The boy, who had been on life support, died late Thursday, Officer Jason Willingham said.

Day-care worker Vicki Leigh Chiles was arrested and booked into the Tulsa Jail on a felony complaint of injury to a minor child and on an arrest warrant that was filed Wednesday charging her with abusing a different child.

Chiles was the only worker present at the day-care home at the time, and a total of eight children, ages 7 and younger, were present, Willingham said.

Chiles told police the boy would not be quiet for nap time and that she used masking tape to bind his hands and cover his mouth to keep him quiet, an arrest report states.

Chiles told investigators she then left the boy unattended for a few minutes and came back to find him lying on the floor unresponsive, the report states. She said she called for an ambulance and tried to perform CPR.

While the emergency was unfolding, Oklahoma Department of Human Services workers arrived at the house to conduct an inspection of Chiles' day-care home, Willingham said.

The Oklahoma Department of Human Services, the agency that oversees child day-care operators, was in the midst of an investigation into Chiles' business, said Mary Leaver, a spokeswoman for the agency.

Well... what grounds do you have to sue on? I mean, it was mistreatment that ended up killing the child, but unless you pull out the waaaaay too atypical "emotional distress" crap, there may not be anything to sue over. It does sound like she's been doing this kind of thing before, so if the daycare people (it sounds home-based, but they mentioned that there are others) knew about her behavior, they may be able to get the daycare on negligence in firing her for her poor judgment and ability to work with children.

i guess because their daycare lady basically killed their kid... anyways, everyone is suing so that is why i said i can understand why and would not be surprised. If she was any type of legit daycare at all, she should have coverage under some type of insurance/liability policy.

How do you figure there aren't grounds to sue? She killed their kid...this is one of the few cases where suing for negligence and emotional distress is actually warranted...😕

One has absolutely one thing to do with the other. For that matter, why not home school your students instead of letting the public school system or a private school handle it?
