Richmond -- A 12-year-old boy has been convicted of sexually assaulting a 46-year- old woman along a hiking trail in Richmond, the prosecutor in the case said Tuesday.
The boy, whose name was withheld because of his age, was sentenced Monday by Judge Lois Haight of Contra Costa County Superior Court to serve a term in a locked facility with the California Youth Authority, where he will be enrolled in a sex offender treatment program.
The boy probably will not be eligible for release for about four years, although his term can be adjusted depending on his behavior, said Deputy District Attorney Steven Moawad.
The boy overpowered the woman and sodomized her repeatedly April 16 along the Wildcat Canyon Creek trail near Verde Elementary School in Richmond, authorities said. The boy was found hiding in a creek about 90 minutes after the victim reported the assault to East Bay Regional Park police.
The 12-year-old was initially charged with four counts of sodomy and one count of attempted oral copulation, all felonies. On Monday, prosecutors dropped three of the charges, and the judge sentenced the boy on two of the sodomy counts.
The plea agreement keeps the victim from having to testify against her attacker, Moawad said.
The boy is among the youngest defendants ever to be charged with sexually assaulting an adult in the Bay Area, an expert in juvenile crime said Tuesday.
Dan Macallair, executive director of the Center on Juvenile and Criminal Justice in San Francisco, said he feared the youth would be even more hardened after his release.
Macallair said alternatives to incarceration included probation or inpatient psychiatric programs.
