If we assume he is guilty, the whole sentencing is going to rely on whether a 12 year old can form mens rea. The issue with sentencing children as adults is whether they can form the intent necessary to commit the crime. If the kid was say 16, then I'd say yes definitely sentence him as an adult. A kid that young... you're starting to get into a vary grey area.

Whatever. When we all growing up we knew perfectly well what we were doing when we were 12. At that age you know right from wrong, you know killing someone is WRONG. If this "kid" hasn't learned it yet, it's best he be removed from society ASAP.
 
SCOTUS ended the death penalty for anyone under 18 a while ago. Can't give them the death penalty anymore, and all those that had been given the death penalty at the time, were changed to life in prison.
 
No, we don't need to do that here. If he was intent on killing her he would have anyway, a knife, a club, smothering, etc, etc.
He would have *tried* anyway using another method. Knifing, clubbing, or smothering is a lot less effective for a 11 year old than a shotgun.

I read that the average inmate cost is $25k/year.

He will be in prison for ~60 years.
$40k/year (estimate based on inflation) * 60 = $2.4 Million

OR

Put him in juvy for 6 years.
$25k/year * 6 = $150k

The justice system is retarded.

I'll tell you what, we'll make up the difference by letting a bunch of repeat offender potheads out of jail.

Wow that's crazy. I wonder why they decided to treat his case as an adult and not juvenile one though.

In a way, I do feel sorry that he will have to spend his entire life in jail, and he never even got to experience the real world at all. such a waste of life. On the other hand, at that age even if very young, he should of known that killing someone is not ok. It's not like it was an accident or something.

I won't get into the gun control portion of this, that's a whole other topic that's been overdone. 😛

Here's my take.

Any kid that commits a violent crime like this is showing serious signs of mental problems. Deranged at best, psychopath at worst. In either case, the kid will not be a good member for society. Age in my opinion has nothing to do with this as the child has problems he will never be able to overcome. You can't change a psychopath no matter how much "counseling" they are given. They lack certain brain matter and areas that deal with emotion and empathy and nothing can be done to "fix" that.

Premeditated murder by anyone of any age is clearly justifiable proof of mental instability.

Now as for my opinion on if the the kid in the article actually did the deed, the article doesn't give enough information on the specifics of the case evidence. So I have to withhold my judgment if he did it or not.
 
whats the point of having juvenile laws anymore? if the kids was 17 yea i can see adult charges but not a 12 year old.
 
These cases are interesting. A 12 year old can be considered "adult" enough to understand/be responsible for murder, but a 13-15 year old cannot be considered "adult" enough to understand/be responsible for sex. shrug. A topic for another thread perhaps, but interesting. I don't even know how I'd go along with it.
 
that is such bullshit... It's double homicide if you kill a pregnant woman but it's not homicide if you have an abortion! How retarded is that! Oh and for the record, I'm all for abortion..
