Bought a phone off ebay that doesn't work

Phone was $90 + $25 shipping or something.

The speaker cuts out frequently. The phone was 'new' but was manufactured 15 months ago, and Motorola can't service it.

My expectation is that the seller should reimburse me for everything minus his actual shipping charges, not minus the 'shipping' charge on ebay. This means that I should get about $110 back, not $90, correct?

Is this an unrealistic expectation? I don't want him pocketing twenty bucks and doing this repeatedly.

you should get EVERYTHING you paid back. if the seller does not agree to this, file a paypal dispute before returning. The only thing you should pay for is return shipping.

if the phone was truely NIB, then it is up to you to seek warranty service, and if it is not available, your loss. If the box was not sealed, the seller owes you a refund of all upfront costs.

even if it was NIB, buyer would win the paypal dispute

If I were the seller I'd give it back at least less the actual shipping. But I think you're correct he's under no obligation too.

Paypal requires the total amount to be refunded if the buyer files and wins a dispute.

The $25 is technically Shipping and Handling. Since he handled it I doubt you'll get anything of that back.
