They do. See border patrol agents that were sentenced to 11 years in jail for shooting an illegal alien drug smuggler. Sentences were commuted when Bush left office.

IMO the Border Patrol needs to be replaced by a more military like organization, sort of a land version of the Coast Guard. It's time to start being honest with ourselves about that the situation along the Mexican border is like.
