If I am not mistaken (which I may be), the OP's actions have already caused harm to some of the higher level employees within the company itself. I'm simply saying CYA, as from top to bottom the OP talking about this publicly at this point could be doing more harm to his credibility than good.

If you're saying that the OP could be incriminating himself or providing evidence against himself for a tort action brough by the company for things he may have done or said outside this thread, that's much more plausible than suggesting that his posts here could be considered libelous with demostrable damages.

Like I said, just all CYA stuff at this point. I applaud the OP for what he's done. Takes common sense to do such a thing, which unfortunately few people have. Takes balls to continue through with it though, given everybody and their mother will try to make your life a living hell for potentially ruining theirs in the process.

Yep, very illegal. Depending on size of company they have a certain period of time to deposit. Also, if they miss it, the plan admin is supposed to calculate interest/gains lost and the company must make it up.

This reminds me of that guy here that went into crazy unbelievable stories about how he was being watched and set up by law enforcement but it turned out he had post traumatic stress from a murder he had witnessed and he was delusional. His friend was shot in front of him by an escaped convict. They caught the guy but I guess it screwed him up mentally. Man that was sad.

Do yourself a favor and contact a labor attorney. This way you will know what kind of documents to keep for yourself. You are now a protected class since you are a whistleblower, so anything detrimental to you that happens going forward may be cause for an EEOC claim.

Great advice:

On the 401K thing they are in violation of DOL & IRS rules. Untimely deposits require them to true you up at the end of the year or whenever they know about it. They will have to look at the average rate of return for the funds you are in and give you the amount of interest/earnings you missed out on.

Contact DOL & IRS ASAP as well. Your labor attorney should be advising you heavily on all of these matters.

Update resume and get a new job - this place will fold.

Hope someone doesn't get pissed off and pay someone to whack you. You might need a protection program depending on who your bosses shady friends are.

EDIT: Do you have a family? I wouldn't pull this kind of crap for fear of my family's safety. When people who have money LOSE it, they tend to get pissed.

Wow, I'd try and get that 401K$$ moved into an IRA if possible, PM Fern, he's a CPA I believe and knowledgeable about these things, he helped me a lot. Also as already suggested, get a lawyer, I did and he helped me win my UI case, best $300 I ever spent. Sounds paranoid but might want to look at buying a gun at this point, your obviously dealing with total scumbags, who knows what level they will stoop to..

BTW: crazy story, OP. I remember your earlier threads and glad that you are following up on this. Maybe not too surprising--I imagine that a halfway house is one of the few types of places that can and will hire former convicted criminals (is it the prison --> real world type of halfway house). This kind of blatant criminality seems like it would be more common here.

But I worry that your posting all of these details on a forum will come back and hurt you.

If that happened here (in the UK), the government would have suspended everyone pending the full investigation. You would have been back in work the day you were cleared, and given full investigatory notes as per legal requirement.

In your case now, lawyer up, and fast, and if there is a workers union in your area, join one. I know they are a taboo in the US for the most part, but when you need them, they'll have your back, especially in government establishments, as government employers hate unions more than anyone.

Honestly, your home is on file at the company. Those paychecks go somewhere (no, you get EFTs, but it's still on file).

All it takes is a drive out to your house and waiting for you to leave your house. No trouble at all, especially to a desperate hired goon. Fires aren't hard to start either. There's a reason people avoid snitching...
