You are wrong on two counts:
1. Although it is not illegal to download here, it is illegal to upload. And that download loophole is based on a shaky split decision of the SSC, which could easily be overturned in another test case with only a slightly different situation. Also, there was an updated copyright law tabled in the last session of parliament, which would have illegalized downloading. The only reason it's not on the books now is because the proccess was interrupted by the election. Now, unless you think that the conservatives are going to be less corporation-friendly than the Liberals, we can anticipate another version of that same law to be tabled in this session.
2. There is no law that prohibits the RIAA from suing Canadian citizens under Canadian law. They could do it anytime they had cause. Also, we have the CRIA up here, which is essentially the same body.
We are currently enjoying a quasi-free copyright regime in terms of downloading music, but don't take it for granted. It's gonna come to an end soon.
