Well yeah nothing is ever going to be perfectly designed but what is the alternative? Have it be perfectly legal?

The hurdles to overcome on this one aren't as small as the connotation of your reply suggests.

And even with those examples you gave if it can be established that the charged party informed anyone of their HIV+ status then he/she will still have a strong likelihood of being found guilty.

That's a very big "if".

If someone is knowingly spreading HIV/STDs they should be prosecuted.
They are.

The very first prosecution in Canada was right here in London Ontario back in 1993.

The first Canadian citizen ever charged with failing to disclose his HIV status to a sexual partner was Charles Ssenyonga, a Ugandan immigrant living in London, Ontario who was charged with aggravated assault stemming from three sexual encounters in the late 1980s. Ssenyonga, however, died in 1993 before a verdict was rendered in his case.
I believe most infections are accidental, not deliberate.

They posted gun owners information online . . . as if they were dangerous . . why not post a database online of who has STD's so you can avoid them?
