best buy memo said xbox bundles only, if possible

Best Buy was advertising a nine AM opening time on the 22nd and stores had to stick to that time. Best Buy had such low quantities that it needed to be careful with the advertising. The memo said that if stores opened early and sold all their units before that time, it could be in trouble for false advertising.
the store nearest me opened at midnight, and so was sold out at 9 am. i wonder if they could be sued for false advertising?
 
Best Buy is awesome. I do all of my shopping there, I really think they help me stay on the bleeding edge. Did you know that your regular USB printer cable can cause interference and lessen your print quality, I do now. Gold is apparently a much better conductor and helps prevent this. Thanks Best Buy.

The memo said that if stores opened early and sold all their units before that time, it could be in trouble for false advertising.
obviously best buy was worried that if they opened before 9 am (which the store nearest me did) and sold out before 9 am (which the store nearest me did) then they might get in trouble for false advertising.

I won't spend less than $30 for a usb cable. I also enjoy won't pay any less than $100 for a Monster brand surge suppresor.

I always buy my TVs at Best Buy. I make sure to order thousands of dollars in accessories and get my 42" plasma TV for five dollars.
Then I return all accessories the next day.
 
The BB in my hometown wasnt sold out of 360s till the day after Friday. 40 some units took awhile to sell to doctors and IBMers.

While gold is a good conductor it's not worth the cost over copper. You might want gold connectors though as they won't corrode.

That very well may be true. But that is not the important question. The important question is who can sue. Customers cannot sue for false advertising - a very common misconception. Only competing stores can sue.

In the lawsuit they must prove several things:
1) There was a false or misleading statment of fact about a product. :thumbsup: #1 is easy.
2) A substantial segment of your store's customers would have been misled. Toss up here.
3) The customers acted differently due to the false advertising. This is nearly impossible to prove.
4) The product is in interstate commerce. :thumbsup: #4 is easy.
5) That your store was injured as a result. :thumbsdown: You lost the case here. How are you going to prove a store that sold out itself was hurt?

i don't know why you think it must be a federal claim

states have jurisdiction too, ya know. could very well be they give consumers a right of action for false advertising.
