Bankruptcy hearing tomorrow

Since the new law went into effect, I was kinda nervous but it looks like my numbers came in just about right. Now it's a matter of hoping no damn creditors show up tomorrow to contest and that the BK trustee doesnt have too many hard questions. I'm hoping to be out of there in 10 mins. This is the second time I've been to court in my life, and I'm hoping it goes smooth.

I've moved on with my life and a new job. I just hope I can put this all behind me! :beer:

A normal 314 meeting takes about 7 mins but mine lasted 45 mins. A creditor showed up (something about female lawyers, so hot) and asked me a couple of questions. They (the trustee) drilled me on my business. Wondered where $150k went in a year and I told them that it went into a failing business. I didnt buy any luxury items and nothing has been secretly transferred. So now we have to produce more statements and send them to the trustee. Worst case scenario we dismiss the case should they subject me to Chap 13.

The "good" thing is most of my debt has been discharged once they found out I was filing for BK. So, there's not much anyone can do. I just dont like the two lenders trying to come after me since they filed a judgment against me. We sit and wait.
 
If the ducks are in order, there should be no hard questions.

Creditors will show up IF they think you have something that they can justify getting their hands on.
 
I filed just before the law changed. There were no creditors in the room and there was about fifty cases. If your paperwork is good the questioning should be short. Best of luck!

Lawyer knows the BK trustee overseeing my case and he says she's so pleasant. So, thats a good thing for tomorrow, I dont have to sit in front of some grumpy person who's out to get me. On another note, we havent heard from any creditors once the Dept of Justice made it known to my creditors that I'm filing for BK. There are two lenders I am afraid of and they are big. I owe two $50k line of credits to two banks and they havent responded or anything, which could be good or bad. I just hope they dont show up tomorrow. Then again, I sit tight for 2 months hoping no one objects to my filing.

My lawyer flooded the BK ppl w/ lots and lots of paperwork. Technically I own NOTHING. I am renting and the car is paid off. I just got a new job in July and I'm starting a new life. I just hope they feel sorry for me and let me go. It was a bad business decision where my fvcking former business partner got away cleanly. All the loans were under my name since I was the one with good credit. Now I'm hurting but hopefully if I get a discharge, I can start my life all over again. I'm 26 so im not too old. 😉

Life has been much better, no worries about paying bills and the stress that caused. I have a student loan that couldn't be discharged and that's actually helping me rebuild my credit.
 
ilcam: It sounds like the lawyer has everything under control. If you really have no assets, and that depends on how much the car is worth and what your state's laws are, I wouldn't worry about the creditors. Like the old saying goes you can't get blood from a stone

yea i hope so. i freaked out upon receiving the letters from these two banks regarding judgments. It said they were going to come after my money and/or property. While I dont have much, I didnt like living w/o direct deposit. I had to cash my check and had to carry cash w/ me at all times. No credit cards hurt even more since I couldnt rent a car when my car broke. I just hope these two banks realize I dont have ANYTHING and leave me the hell alone. As my one friend said, they have bigger fishes to fry.
 
If you still have a check card some rental agencies will still take the account number off that. It does kind of suck carrying cash. I still cash my paycheck a year later at a currency exchange, but that's because my bank, which wasn't involved in the bankruptcy, sucks.

My paycheck is issue by one of the banks that has a judgment against me!
My lawyer says they can't do anything about that, but it does worry me.
As long as it's being direct deposit, no one will know since the bank is issuing me the money in care of my employer. When I go to cash it, they hold me there for 15 mins at times looking through a whole bunch of menus. God, I just hope all goes well.
 
I'd consider cashing my check at a currency exhange. That sounds kind of scary that you have to deal with the "enemy" during all this.

Unfortuntely yes. For me it's a piece of mind not worrying about my bank holding the check too long before the funds are available. I usually cash the check and then go to the bank and deposit what I want into the checking account
