backyard fence question

This doesn't apply to me, but I was just curious.

So lets say the backyard fence that seperates your house and the neighbor's house needs to be replaced?

Is there a general 'rule' as to who is responsible for it? I know the good neighbor rule would just be to split it 50/50, but are there actually rules as to who owns the fence and is legally responsible for it?

I have heard different things ranging from
1. depending on which side the posts are on(If the posts are on your side, then the fence is yours)
2. from the middle of the fence and to your right, you are responsible, etc etc

any thoughts?

Yep, I put in a new fence on the side of my house and they wanted no part in the bill. I got the no-post/good looking side.
 
it depends. if my neighbor puts a fence up and doesn't see if it's ok with me, then he foots the bill when it needs replacing.

plus, the nice side has to be on your neighbor's side, in most municipalities.
