auto claim denied..!!

I'm so frustrated.

over the weekend, I had a car accident. I was leaving the parking lot and as I was going straight toward the exit, some guy drove really fast past me on the intersection right in front of me and caused me to hit him. I was already past the intersection when he came in front of me. he pulled my whole driver side bumper out.

I filed the claim with statefarm, (his insurance) and after speaking to their driver, they said it is my fault because based on their investigation, their driver was already fully into past the intersection, so I had to yield.

man, I am so mad at this. there were no police because it was in a parking lot, and no witnesses.

do you guys have any tips? I dont want to file on my own, then I will have to pay the deductible.

Option 1. Take the guy to small claims court, and recover the cost of the repairs.
Option 2. Report it to your insurance, get your car fixed now, pay the deductible. Your insurance company will take the responsibilty of recovering the money from the other guy's insurance.
Option 3. Pay for the repairs yourself and forget it ever happened.

they can still write up a report and pull video (if the lot is covered). at least thats what they did when someone hit my car at the parking lot. made it very easy to file and wina claim.

Good luck fighting Snake Farm.

File on your insurance. If you can convince your carrier that the other driver was at fault. (not likely) Your carrier can subrogate against Snake Farm and get your deductible back.

I need a diagram. In most parking lots there is usually one direction that has a clear right of way.

Around here they won't file a police report if it's on private property (i.e. parking lot at a mal or something like that). Apparently they only can write up a report if it's on a public road.

That said, seek counsel OP. State Farm will do nothing for you if you rep yourself though a friendly call to that agent from your attorney might help persuade them.

Did the other drive admit fault to you when this accident occured?

My feeling is you're screwed. It's one of life's little lessons.

Best is to report it to your insurance, the worse that can happen is that you can't claim nor can they ... so you pay your deductible to have your car fixed and there shouldn't be any points on your insurance since both parties are denying guilt.

You're dumb NOT to call the cops. My wife was just in an accident on private property (my sons school). They wrote up a report, but the officer wouldn't say who was at fault. He mentioned someone else at the department would do that. It's also nice to have their story in writing right there on the scene. It doesn't give them time to change their story later.

Anywhere I've lived the police come and write a report.


What they won't do is give a ticket, if it's private property.



This helped me twice in a situation where it was obviously the other person's fault at the time, and they were like yeah.. sorry... then their insurance company convinced them they did nothing wrong - too late.. police report shows they admitted guilt.

My wife was in a fender bender at the police station parking lot...and even there, they wouldn't do anything about it.
