The card is good. I got the non-refurb, supposedly OEM from NewEgg at 138. It came retail-packaged. A nice big improvement over my GeForce3 TI 200. Best upgrade money I spent to date. (Especially since I'm sunk deep into FarCry...)

This is the one you want - Link
The Powercolor 9800SE 256bit model with L shaped memory.
$121 refurb or $157 new
Softmod has a 70% chance of working and oc's well.
Do you feel lucky?

I do, I ordered the refurb last night :D

I also have this one - Link
Sapphire 9500 non-pro with L shaped memory
Softmod turned it into a 9700 and oc'ing made it perform better than a 9700 Pro.
5800's in 3DMark03

There is a 90% chance that the reason those cards are refurbed is because they already failed to softmod and were returned.

Certainly a risk, but your blowing smoke with the 90% probability.

I got this card and it MODs fine ... no problems at all in opening all 8 PIPEs

Wow lucky you! Mine had plenty of artifacts after modding :( Like, 10 diagonal rows of white-dot-pairs (little eyes) across the screen. At least I got a sneak preview of the 9800Pro's awesome capabilities. Really awesome and well worth the price difference IMO.
