Apple sues Samsung over Galaxy S' "similarities" to iPhone

I wouldn't be too sure about the lawsuit being dismissed.

Apple likely doesn't want money, they want production to stop, and they want to send a message to the other manufacturers.

Why wouldn't it be dismissed?

F700 hit the market before iphone and along with it's UI predate the iphone. If anything, had Samsung patented that UI and whatever appearance aspect that Apple patented, they could turn around and sue Apple back with much better chances in court.

2) as to the iPhone and iPod touch products, substantial black borders above and below the screen having roughly equal width and narrower black borders on either side of the screen having roughly equal width;
3) as to the iPad product, substantial black borders on all sides being roughly equal in width;
4) a metallic surround framing the perimeter of the top surface;

5) a display of a grid of colorful square icons with uniformly rounded corners; and
6) a bottom row of square icons (the “Springboard”) set off from the other icons and that do not change as the other pages of the user interface are viewed.

The first four seem a bit flimsy after seeing the Samsung F700.
 
I don't think Apple expects to win this one, but it is still a strategic PR move nonetheless. It probably would've come earlier except for Apple's reliance on Samsung for chip production until they signed the TSMC deal. There's no question that Samsung pegs their phones, tablets, MP3 players and 9 Series notebooks to Apple's releases. Samsung, as big as it is, lacks some innovative drive at the top. They take what works and release their own version of it.

By filing this lawsuit and at least putting the notion into the public's mind that Samsung copies Apple (which they do, albeit with enough differences to probably make it legal), it'll pressure Samsung to vary their design elements more when the next big Apple product comes out.

Whomever came up with that is pretty sleezy. They conveniently replaced Samsung's icons with default Android icons if the Samsung one wasn't close enough - like the SMS icon.

They did? On which ones? That's my default SMS icon on my Galaxy S.

Are you running TouchWiz? Maybe I'm wrong and they use different icon sets for different versions of the Galaxy S - but my Vibrant's SMS icon looks nothing like that (that's the default Android icon).

Doesnt seem like this guy has any skin in the game. Are there any other ones besides the SMS one that they changed? Looks like someone already debunked what you said, pointing out that its the default icon on their Galaxy S

I just did a quick image search on all the models - it appears the Galaxy S, Vibrant, and Captivate use a different icon as I said - see the lower right:

The Fascinate and Epic 4G, curiously enough, do use the standard Google messaging icon, shown in the image you posted. So I Nilay may not be sleezy - but certainly cherry picked nicely (or he just uses an Epic and doesn't know any better).

The contacts and notes image on my Vibrant are also a little different from the one they showed, but it could be for the same reason.
 
My contacts and notes icons are identical to those he posted, although there's a little more shown on his posted pics than on mine, just as the one in the phone you pictured (same with the Gallery icon). It's like there's an added bezel or something.

Yes, I do enjoy my iPhone quite a bit. I have been enjoying the iPhone since the day they unlocked it for t-mobile (90 days after its release). Long before android even came around.

You still dont see me in every single android thread bashing others' phones and their choices. You seem to do this quite a bit. Every. single. apple. Related. Thread. You obviously have some beef with apple.

You come into this thread and write 4+ responses of how samsung should crush apple. This leads me to believe you work for samsung and have some beef with apple. Why else would you spend so much time in every apple related thread bashing the company?
 
Most likely they will settle out of court, or Samsung pays Jobs and co. a fee that Samsung being the multinational they are hardly dents the end of year profit statement or cash flow account. It's just to knock Samsung's morale, Jobs and co. know that the Samsung Galaxy S and now II are few of the true iPhone rivals out there.

That said, my Samsung Galaxy 3 does look a bit like an iPhone, with similar sized capacitive display and buttons beneath the screen. Either way, I'm not bothered who copies who (if even true, you never know Samsung may sue Apple for defaming the company lol..) as long as both companies produce good phones, as a consumer I couldn't give a shit really.

People in the US are just too sue happy IMO. Need some Judges with some stones to throw out more of these silly sue cases and make the party pay for the stupid claims!

Everyone copies everyone. Apple copied things when they made the iPhone and still to this day. Just like Android copies things and WP7 and WebOS.
