You might have heard about the ruling that Samsung is banned from selling phones in EU. Digging deeper though it seems the judge threw out all the design patents that Apple was claiming. The judge also ruled the swipe to unlock patent invalid. All Samsung is ruled as violating is a patent on swiping through photos in the gallery app. It seems can be fixed by an update that Samsung says it will release and they have 7 weeks to comply before the ban is enforced.

LOL I love all the blogs with articles up saying Samsung is banned when they only have to make a small adjustment, and they got a bunch of Apple patent claims tossed.

The swipe-to-unlock patent is interesting, since the judge states that it is very likely that in a 'bottom procedure' (a thorough court case where all details are taken into account), this patent will be declared invalid. He specifically refers to the Neonode N1m mobile phone as prior art, which sports the exact same unlock method as the iPhone. The Neonode was released in 2005.

The best decision was this community design nonsense

Regarding the design related stuff - the Community Designs - of the iPad, the judge threw it all out, citing loads of prior art (like the Compaq TC1x00). In addition, the judge stated that only the front of the device shows some resemblance, while everything else is entirely different. The Kinght Ridder is also cited as relevant prior art - the judge threw out Apple's defense that the product never made it to market. To round it out, the judge also mentioned 'form-follows-function' several times. Most interesting note: the judge specifically mentions that by having such a minimalist design, the iPad basically makes itself less viable for design protection.

Still not sure how you can patent scrolling through pictures though. How does the TW Gallery compare to the stock Android Gallery or the shitastic HTC Albums?

It doesn't matter if the update is ever released to the public. The ban doesn't affect devices already sold. It may not even affect devices already on retailer's shelves; typically these bans are enforced at the importer/wholesaler level.
 
It was pretty funny reading these articles this morning. It started off sounding like Samsung got whooped, then the more you read it's obvious Apple got shit on by the judge. Spin artists are in full force trying to make Apple look good out of this. Fucking dumbshits.

Well, the old way was physical button controls or onscreen buttons that essentially were essentially back and forth buttons.

I will agree with the judge on the prior art citation for throwing out the community design claims but will disagree that having a minimalistic design can't be trademarked or protected by community design. I know people specifically mention the "minimalistic design" comment but it seems the judge threw out many of the claims due to prior art.

This does not bode well for Apple's claims in other territories. If one judge notes prior art and cites many examples, Samsung would have to hire clinically brain dead lawyers or else their lawyers in the other territories will bring up the same cited examples.


And as usual the trolls are out in force.
