Liable? The definition of piracy is a moral line, not a legal one. No one is going to get prosecuted streaming pirate video, unless you are the one hosting the stream to try and get yourself some ad revenue (aka try to profit off piracy).

Netflix in your example would be liable. When it comes to piracy, unauthorized distribution and not consumption gets you in trouble.

Personally I think that if the distribution point you are using is known to be authorized by media companies then you aren't a pirate if they slip up and give you access to something you shouldn't have.

This is so unlikely that I don't think it is a major problem.
