No more lawyers for me --- I hope. 🙂 The funny thing is that I was supposed to be a lawyer instead of an engineer. My grandfather and father were lawyers, so naturally they assumed that I would continue the tradition. Heh.

renters get hosed all the time, it is part of the deal

My boss gave me an advice yesterday. Never rent an apartment. As much as possible, get your own house. He had a similar experience back then. I need to start saving up for a house. Hopefully, this lawyer thing will be resolved quickly.

Really, the area were we were renting was not bad. It was centrally located. The horrible thing was the maintenance staff was a joke. I wish I would've known before I moved.

Real world rule number one: You never get your rental deposit back. Get over it and move on.

Exactly...

I still have not got my first deposit back. My gf and I left the apt exactly how we got i. They calimed we broke the door and that we dirtied the rug. This was the condition of the room when we first moved in. I bugged them to fix it, they refused. AFter, they claimed I never bugged them to fix it. I have decided to quit and move on.

Seems like such an odd spot on the carpet to have pet damage. Was your dog digging at that area with his paws?

Did you mention the carpet damage or did they point it out on the walk through? If it was me I would keep quiet unless it was pointed out. That spot could see strange wear patterns because of the tile next to it and the traffic patterns of the room.

Yep, I told them that since we got him as a puppy, he liked to chew things and one of them was the carpet.

What does a lawyer cost? $300 and up per hour?

Unfortunately, yes. I'll probably just see the lawyer one time and get some additional advice in case they hit me with additional charges just because I mentioned the L word.

So like an idiot, you're going to spend several hundred dollars in legal fees to avoid paying an extra 100-200 in capret replacement?

probably a good thing you didn't pursue the legal field....

I'm not after my security deposit at all. I'm after getting assessed fairly in terms of the carpet damages and other minor wear-and-tear. The units are really old, and the last thing I want to do is get charged for its complete renovations.

hahahahaha

oh man. oh man thats great.

you threaten (even if that was not your intention. thats what you did) them with a lawyer and they did what they should have. Told you OK bye. from here on out talk to our lawyer.

hahah this is going to cost you MORE then if you would have just been nice.

well at least now you know something new. NEVER mention lawyer UNLESS you plan on on using them. hehehe

Actually, it's not just an extra 100-200 for carpet replacement. The damaged carpet was only the bottom portion which is 204 sq ft. I don't mind paying for this. However, they hinted that it was going to cost me more than quotes I received from Lowe's and an independent carpet contractor. If I were to get charged for the carpeting upstairs as well, that will run me around $2000.

I treated them nicely. I politely asked for any itemized cost breakdown and any paperwork related to it. I never intended any threatening actions when I mentioned the advice I got from the L word.

People need to realize that when ever you give a place a deposit be it a pet, security, first last months, what have you, your 99% sure never to see that money every again. They will always find a way to make sure they NEVER owe you a dime back and in most case find a way that what you have already given to them wasnt enough. Never ever count on getting anything back when ready to leave. You can clean, replace carpet, repaint the entire place in and out, they will still find something, like the op's mold, smell, greasy stove, thats nit picking to keep the deposits.

You can call un-fair all you want its just how they roll and been getting away with it, it cuts into their profits, and no place likes to give back several hundred dollars back let alone thousands, so if you putting up this money when you move it consider it gone, no matter what you do when its time to leave and you try to collect.

Yeah, I realize that now. I never wanted my deposits back. I understood that they would be used to cover some of the damages. All I wanted from them was to not get charged an exuberant amount.

thats the point. you did NOT treat them nice. you made a vague threat to a lawyer about the money. it was a threat.

any time you bring up a lawyer in a dispute it is a threat.

while it is going to cost you at least you learned a damn good leason.

isnt there usually a threshhold type of deal when u transition from one type of floor to another. in this case tile to carpet? or is it only from like tile to wood.

I've gotten my whole deposit back at least 4 times I can remember, and only 1 time did I get none of it back. (don't trust teenage daughter to be last family member to leave residence. party FTL 🙂)

as far as the carpet, it might depend on how long you lived there. In Ohio residents can't be charged for normal wear, which for carpet is only a few years to be completely replaced. Of course, that wouldn't apply to damage to the underflooring.

Not true...got my complete and total rental deposit back....and I have a dog. Just rented a carpet cleaner for the day and actually *gasp* cleaned the apartment well before I left

Never escalate a situation before you have all the facts, and never swat a fly with a sledge hammer.
You tried to intimidate them right off the bat and it didn't work, now your going to spend money on legal advice before you know if you need it. To be honest, it sounds like you have a little mans complex, and you're going to prove to the world that you won't be pushed around.

I don't see where anyone mentioned you would have to replace the upstairs carpet, nor do I think they would expect you to.

At one place I moved from an upstairs one bedroom to a main floor one and a half bedroom in the same complex. For the first apartment I only vaccumed and pushed some lysol around with a mop and had my full deposit transferred. When I left the second place my girlfriend and I cleaned for a full day and I got nothing back. "Oh the maid had to clean for six hours" Bullshit! That is just one example. After four years of moving throughout college all those lost deposits really add up! The dorms were the best for not gouging you since the employees did not have a vested interest in screwing you over.
