Apartment staff told me that they can no longer talk to me...

So, I went thru my final walkthrough for our apartment. We were ending our lease, so I made sure that one of the apartment staff went with me to check the place out. The only bad things that came out of the walkthrough was the following: oven greasy, carpet damaged by the dog, room smelling like dog, some minor molding in the bathroom, etc.

So, I called the apartment afterwards making sure that I get all the costs of repair especially the carpet itemized. I also told them that I already got quotes from Lowe's and an independent carpet contractor. Ball park figure for the 204 sq ft carpeted area, which was party damaged by the dog, was around $300+ for the whole thing replaced. We originally paid $300 for a pet fee and it stated that they can deduct some of the damages from that fee.

The lady on the phone told me that the pet fee will not cover the whole thing, so I had the impression that it was going to be more than $300+. I politely asked to also get a copy of any paperwork showing the work they had done to the carpet prior to our move. They did not seem to replace the carpet when we moved in because there was an existing cigarette burn in the upstairs carpet. So, I told the lady that I had consulted a lawyer and was told to get as much paperwork possible. Then, she says that I need to talk to their lawyer and because I asked for a lawyer's advice they can no longer communicate with me.

Tsk. This really sucks. My intention for asking about paperwork regarding the carpet was to make sure that I don't get billed for a brand new carpet if they do replace it. In my opinion, if the carpet really was not replaced when we moved in, then we should be only responsible for bringing it back to its original condition during move in.

Anyway, I feel so down right now. I didn't want to get lawyers involved, but I just wanted this thing over with. I simply wanted them to give me a reasonable cost for damage repairs and paperwork proving that I paid for my share of the repairs.

Well, I never threatened them with lawyers. I simply stated that I asked for a lawyer's advice regarding the lease and getting everything straightened out.

I'm simply stating that if I borrowed your used bike and somehow I damaged it, then I should not have to get you a brand new bike if I can get you the bike back to its original condition. Is this a wrong perspective?

Just add it in as part of the cost of pet ownership. Of course they're gonna hit ya up for a complete replacement.

Believe me, I tried to tell them that. But I was promptly cut off before I could explain myself properly. I can't call them anymore because I don't want to make this worse than it is.

Yeah. I think this will be my first and last pet.... well, until I move into a house, then I don't have to worry about possibly paying outrageous fees for repairs.

Any smart person would end the conversation the instant you whip out the "L" word. Anything they say or do could be used against them. Threats of lawsuits and lawyers (it doesn't even have to be a threat... just the mere mention of it) are like guns... If you're gonna pull it, you better be ready to use it.

Yep, unfortunately, I have to bust out with the big guns now. I have already contacted my lawyer to see if she can help me sort this thing out. I just want it to be over with. I already have the paperwork sorted out, more pictures of the place, and some videos. So, I'll have to own up to this and play their game.

If that is the only damage I would think that the carpet could be stretched and retucked. Next time you might post something like this be for you threaten to

They will probably say the fee you initially paid to have a pet in the apartment was for the extra cleaning required, not for actual (physical) damage.

The *SECOND* you mention a lawyer, they will clam up.

Not to say they aren't acting like asses, but in the future, DO NOT mention lawyers in any way, shape or form, until you HAVE to.

Let me know what you find - I live in Tampa and may be looking for a new place too...

they get anxious, or worse, pissed off when you mention a lawyer because of the ramifications that only affect them.

Sounds like your a prick. Before even being told the costs of repair and how much you would recieve back, you are threatening a lawyer. Another good reason why I run background checks on new renters.

Listen, being a prick is the last thing I want to do. I did not threaten them with a lawyer. I was merely seeking legal advice regarding the lease and its terms before we ended the lease. I just mentioned passively that a lawyer had told me to get all the paperwork as much as possible. I have no intention of getting lawyers involved. I do, however, would like to get assessed fairly in terms of the repairs needed. I did not know that by mentioning the L word everything would go haywire.

Anyway, lesson learned. You might also want to read the apartment reviews just to get an idea of what other people have been saying about the apartments.

see what you should have done is said. i want the paperwork for my records. simple. using the L word wasa mistake.
