Here is the lease.

I checked a while ago to see what the Fee's are if i break the lease (end it early). Here is what it says.

Basically unless they find a tenant i would still need to split for half of the apartment plus any other costs the management company wants to throw at us. That is if i break the lease.

If i just refuse to pay and the ex cant afford it we go into default, which includes collection agencies and other fees until all of the remaining rent is payed.

Also wouldn't i then be open to be sued from my ex if she wanted to because I wouldn't pay her and then went into default?

If you moved out voluntarily, you are screwed. If she said you have to get out, you can sue her for unlawful eviction and get your money back.

You signed the lease, made a commitment for a year - you are on the hook for that year unless there are provisions for breaking the lease in the lease. Since there is not, pay up.

There's probably nothing you can do without taking a hit on your credit report, but the good news is she'll be in for the same punishment as you. How much is revenge worth to you?

In any case, you should at least try to talk to the management and explain the situation. Worst case scenario is they tell you to walk and you're in the exact same situation as before.

Too bad you didn't get married. A friend of mine is going through a divorce and his wife moved out. Even though they are both on the mortgage she is paying $0 towards it currently. Oh and she will get 50% of the profit when they sell the house.

Lot of expensive lessons in this thread.

i don't think a pre-nup covers items bought after marriage. So if you get married then buy a house, win the lottery, etc it gets split. Pre-Nups cover the millions you had before marriage (and then only if it holds up).

you should move back in and make her life hell until she decides it'd be better to get a new roommate. she can't make you not stay there, after all you are paying half the rent. see how it goes for a little bit and every now and then suggest she get a new roommate.

its your place as much as hers if your name is still on the lease.

solution
step1: pay what is left all at once if possible
step2: tell xgf to go fXXX herself and dont talk to her again

Yeah i would do the above things but i live 6 hours away now! Thanks to a new job on top of it, i still cant get out of the lease because she would have to agree to let me off it.

I definitely am ****** unless I find her a good roommate that SHE agrees too.

Blow my ****** head off will ya?

Most likely i wont pay her the last month and tell her to suck it up, that way she cant do much about it but come up with the cash.

wtf? if you've moved out you shouldn't have to pay. either live there and suffer the awkwardness, or have HER move out and you can pony up the rent.

How is the last month any different than any other month? The landlord doesn't care who pays, as long as they get their rent in full. I would think she could take you to small claims court over it if she wanted to though?

My lease has an option where if I move more than a 50 mile radius away from where I live, provide a letter from my employer stating the above & give 2 months notice, I am good.

Check your lease to make sure if there is something like this.

Exactly. If i do it to early she could take me to court if she wanted to for over $1500, versus just the last months rent. Which she would IMO just pony up so we don't ever have to deal with each other.

I have that too and I talked to the manager, he said the other lease signer (my ex) has to agree to take full control of the apt. And if she doesn't im stuck. ( and she refused btw).

Call a lawyer who works in the state. You might get a free consult, or at worst, pay a few bucks for an hour of advice.

You're on the lease and paying for half, that means (at least, in the majority of places) entitled to full use of the place. Since that's not an option, you need to look into your state's laws about whether or not you can sublet or assign your half of the lease. Otherwise, you're stuck paying, unless she made you leave.

In all honesty I wouldn't pay her a single dime. You're 6 hours away, not much she or the leasing company can do. I've bailed on many a lease, nothing ever came from it.

You have two options...

#1. Call her bluff. Stop paying your half of the apartment. Stash the money away and wait for her to make the next move.

#2. Cut a check for the next three months and chalk it up as a lesson learned.

I moved out broke up and took another job next to family.

Was it a small time landlord or a large apartment complex company?

Call the local PD. Tell them she is selling drugs out of the apartment. That would make for a fun weekend. :evil:
