Aparently I signed a 12month contract with my cell phone company.

I called up my cell phone company to cancel my service since I don't use it enough for what I pay, and they told me I had to pay $90 to cancel my contract early because I signed for a 12month contract. But I was never asked if I wanted a 12month contract when I signed up! On my contract which I signed the 12month box is not checked off, neither is the 24month or 1 month.

What can I do?
 
If you are sure it's not a 1yr contract, I'd write them a letter and include a copy of the contract. Send it certified receipt.

If that doesn't work, you could Get a lawyer to write them a letter. Probably will cost as much as the contract cancellation fee though.

Or, just ask for a cheaper / cheapest plan. Might be able to save a few bucks.

Maybe see if they can suspend the contract for a few months until you may need it again. (You'd still have x Months left, but, at least you can save a few bucks now while you are broke).


 
Most cellhphone contracts are 1 year in the UK, and it's only after 3 months you can cancel them, they need to have a minimum length or the phone company isn't going to make any money. I would expect that the standard contract is 12 months, and if you didn't specify anything different, then it's you own fault for not checking. Maybe after a few more months they won't ask for a cancellation fee, you could check about that.

in the US, most are 1 year as well.

If the boxes are NOT checked then demand a copy of the contract that says you signed up for a year. If it was not checked, and it doesn't say it anywhere in the contract, its not a contract.

Cell companies love to stick it to you, lol.
 
What length of contract were you under the impression of having?

I've never seen any contracts shorter than 1 year. Didn't even know 1 month ones existed.

Actually the ethical thing to do is to pay the $90 to cover their costs since you don't want to stay the year. Did you really think it was a month-to-month contract when you signed it?
 
Plus did you get your phone from them too? Most companies only give you the phone for free/ discounted price if you agree to a 1 year or longer deal.
