Yes it's legal in NC. Based on the average housewife in her Mercedes SUV, it seems to be mandatory. Anything but actually paying attention to the road or using inconveniences like turn signals...

Not illegal in VA, from what I'm aware of... only state I know driving without hands-free is NJ.

Well, the reason I ask is I'm flying in to Norfolk on Saturday night and renting a car to drive down to NC for my sister's wedding. I will probably call her on the way or if I get lost (not bloody likely) and I don't want to get hassled by the cops.

Well, like said above, the larger the car, the larger the fine if you're caught not talking on a cell phone while driving.

Make sure you have a good battery or a small car. ;)

Most of my recent near-miss accidents involved women in Suburbans or Yukons who were talking on cell phones.

I can understand that women should be on the phone when driving luxury cars but how about the poorer women?

cops will not hassle you in NC unless of course you are african american, have tinted windows, have a rainbow sticker, are of spanish descent, are of peurto rican descent (they cant tell between), driving a fast looking car, are under 42, are over 63, are wearing a hat, look like you do drugs, look like you have have had a drink in the last 3 years, are in college, or if you appear to be from out of state.

other than that its not illegal but when does it need to be illegal for cops to harras you in NC.. .. no im not jaded :beer:

Well, I'm white but I am from out of state and I will be driving an '05 Mustang. Also, I am under 42, I will not be wearing a hat, I have short hair but I do not have any facial hair. I plan to do all my drinking after I arrive at my destination.

I will be driving late at night on Saturday through an area I've never been to before in a fast looking car with Virginia plates though. I have a California driver's license...I'm fvcked aren't I?

You're ok in VA... but not in DC.... not sure how far north you're going.

If you go to prince william county VA be prepared to drive the speed limit, and don't even look like you're thinking about driving reckless.

i drive w/ my cell in NC when I totally must and it's not a problem.

WARNING: VA cops will nail you for 4mph over. DO NOT SPEED on VA highways, AT ALL.

NC you can just roll w/ the traffic most of the time, but still don't roll over 10mph+ too much.

You forgot that NC and Virginia cops get hard ons when they see out of state plates.

And by the way, enjoy the Outer Banks! It's such a lovely place...I live 1 hour from there and go about twice a month. Just went last weekend for a 3-day weekend there. The weather is very unpredictable (one minute sunny, next cold and windy) but when you get a beautiful day, it's unbeatable. Make sure you visit Jockey's Ridge (a cool mountain of dunes you're allowed to walk on) and down that strip of highway is the bulk of your shopping/eating opportunities.

If you drive down highway 12 towards Duck (a town) you'll find great "beach access" points. It's wild for ppl that have never been here...down highway 12 you literally are driving miles between 2 sand dunes. Dunes on each side and a strip of highway in the middle you ride on...awesome stuff :)
