Either way, I hope it works out for you. Is the town really called Monkey Island?

I've never had it happen to me, but I've heard of it happening. If you own a business with a specific name and someone registered your domain, you might be able to take legal action.

On another note, good luck with the pub. Doesn't really look my style, customers are a bit old for me :) Maybe it'll be good for you to get the perspective of a small business owner.

Can't get any more specific than the Pub here. It's been here since 1991.

Do I just hire some sort of a Federal Lawyer?

Next time watch where you search for availability on your domain name. Lots of the shady places turn over there whois records to domain squatters.

Unless your business was pre-existing, and you can prove this guy is not going to use the domain for anything but selling it, you're SOL.

Pre-existing, he has no business grabbing the name.

He lives around the corner and thought he can make money off me by grabbing it.

oh, then just go visit him with a baseball bat in hand, and negotiate like Jack Bauer to give you back the domian

To be honest, I'm not sure. Someone posted earlier the law that was enacted making this kind of stuff illegal, but I doubt it'd be worth your money to hire a lawyer to get the domain. It'd probably be cheaper and easy to either buy the domain from the asshole or just stick with the .net domain.

You need a litigation lawyer. It will probably run you $200/hr, but his first action will most likely be to right the guy a threatening letter about it saying "We will sue your ass for my time and Dave's injuries." If you're lucky the guy will give it up, otherwise the ball is rolling and now in his court.

FWIW IANAL so I could be pulling this straight from my ass, but I think I'm right :)

Sounds more reasonable than the ICANN route.

Thanks

He noticed I put this in the Meta tag right away:

<meta name="" content="What happened to MonkeyIslandPub.com? Ask ...... he took the domain name on Dec 17th 2006">

He also accused me of having someone say "nasty" remarks about him taking the name on his website.

I mentioned it to people at the Pub but did not tell anyone to say anything.

I'm thinking of putting the info on the site in plain site and warning people not to do business with him.

Also put the Registrar info which is in this same state as well.

I believe they are conductiing unethical business practices.

The whois info on both domains are different. Did you strike a deal with the guy to redirect to your site Dave?

Anyone have experience with domain name stolen?

I had a guy steal the domain name of my business I bought before I got a chance to register it.

What did he do, break into your server, and haul the name through a broken window?

I just choked on my burrito :)

figuratively speaking?

That actually would be libel, but I think it has to be a public document.

He made the .com page blank after someone posted as he put it "nasty" comments about him.

I didn't see the comments and I did not make the comments.

In my opinion he is slanderous making that claim when he has no proof and I did not say anything.

Well you guys know me.

I certainly don't say anything in "whispers and lies" as he said.

I'm about as upfront as you can get I believe.

Dave, how much does he want for the domain name?

He never said anything about a price, in fact he said it was a "gift" and welcome to the island.

So I thought he would give me the username and password and that would be that.

I wasn't thrilled when I saw the whois all filled out in his name.

Then he said just send him the changes I want to make for the web page and he would post them.

But I said I do my own posting.

I sent him an E-mail showing the transfer process from the Registrar.

I didn't do anything month of January mainly because of the Ice storm (didn't have power for 8 days) and then I registered and fired up the .net.
