You need a litigation lawyer. It will probably run you $200/hr, but his first action will most likely be to right the guy a threatening letter about it saying "We will sue your ass for my time and Dave's injuries." If you're lucky the guy will give it up, otherwise the ball is rolling and now in his court.

To be honest, I'm not sure. Someone posted earlier the law that was enacted making this kind of stuff illegal, but I doubt it'd be worth your money to hire a lawyer to get the domain. It'd probably be cheaper and easy to either buy the domain from the asshole or just stick with the .net domain.
