Anyone familiar with copyright law

I want to know what is needed to consider something legally copyrighted.

Can comeone just a claim that this or that content is copyrighted. Or do they need to copyright by some registration first? Also is someone claims there is something of theirs copyrighted, can u ask for documentation stating otherwise?

 
A Copyright establishes ownership of original works of authorship ?fixed? in any tangible medium of expression. A copyright applies to the expression of an idea, whether published or not. Once an original work is created and fixed, copyright exists. Examples include: books, poetry, plays, short stories, articles, comic books, musical compositions (words and/or music), audio and video recordings, choreographic works, pantomimes, motion pictures, filmstrips, TV programs, photographs, paintings, drawings, prints, maps, architectural plans, scale models, sculpture, craft works, jewelry designs, fabric designs, computer programs and databases.
The PoorMans Copyright (unopened envelope containing copy of item with postmark) is a basic form of this. Also, public recording with notarized witness sigs may serve as well.
The existance of the item establishes copyright.

You dont have to do anything to copyright your work. If you made it, it's legally yours and people can't steal your ideas and reproduce them as thier own.

What's it in regards to, anyway?
 
they way I understood it was that the image was of a guy.. someone modified it and posted it else where.. am I wrong?


In that case its considered free speech.. However since these racist buggers are so sensitive over their cause they are like children. I personally have been called a racist this semester and I know how these ppl operate.. they are only about themselves and only themselves.

I dont believe its a copy right violation.. why not email EFF and find out. I will ask Jen's bf (who is a lawyer) if he can tell me anything without charging me for it.

The only thing I see wrong is using your webspace and your money by someone else.. otherwise everythign is within freespeech laws .. Since there were no copy right images / symbols but rather a picture of somebody.. and the image wasnt "directly" polled from the other server but rather hosted on your server.. your seen as an accessory to the crime.

Images of yourself cannot be copyrighted if I am right.. your not a work of art.

but if you got court over the work, you have to prove it was originally yours.
 
There is such a thing that's called the 'poor man's copyright'. Put whatever you write, like a song, in an envelope. Address it to yourself and stamp it on the back of the envelope. Mail it to yourself. That way, the postmark, stamp, and return address will seal the envelope and be an official date stamp for your work. When you receive it back from the post office, keep it sealed. If there is ever a conflict, you can let a judge open it in court and have the evidence you need.

The picture in question doesn't even appear on the copyrighted page (even an unaltered version of it), so I don't even see why this is an issue.
