Anyone ever fight an HOA fine?

I don't understand why you need permission to move a couch in or why the fine would need to be $750. I'm not a huge fan of HOAs, but I can sort of understand some of the rules. This one just sounds ticky tacky - like they want control.
 
That is pathetic, that they would require you to get permission for something like moving a couch into your own place

My parents' condo has a similar rule. There is a good reason for it.

There is only one service elevator, which must service 52 floors, with multiple units per floor. There is also limited space at the loading dock. Without advance scheduling, there would be chaos with people moving stuff in and out (especially on weekends).

On top of that, the elevators are very nicely finished, and they put protective coverings on the walls when they know someone is moving.

Don't know what OP's condo is like, but sometimes a stupid rule isn't so stupid.

$750 though! Dayumm...well, maybe OP lives in a really expensive place where $75 wouldn't deter people from breaking the rules.

I'll remember to check for HOAs when I buy, or just give condos and closed gate communities the finger altogether.
 
Fight it on principle. It was only 1 item being brought in.
Now if you were doing an entire apartment and tying up
the service / freight elevator for hours or making a lot of
noise, then maybe $750 for not getting it approved first
is ok. But not for what you did, moving 1 item in.
 
No I just needed permission beforehand to do so.

Permission to put a couch in your own condo? Reminds me of when I was a teenager and had to ask my dad if I could put something in my room. This is one of the craziest HOA stories I've heard, and I have 1st have experience with a couple doozies.

First of all, many of these rules are in place to keep the community "nice".

Secondly, damage can occur to the public areas by people moving. By having people register, it is easier to track if/when people break shit.

Thirdly, it allows for the HOA to put measures up to prevent damage such as elevator protection pads.

Fourthly, it allows security to know you are moving YOUR items and not removing someone elses.

But yes, $750 does seem over the top, especially for a first offense.

Either we're not getting the whole story or the OP is confused.
 
Maybe the OP left the couch outside for a period of time. ie: some nosy-body felt is classified as trash/junk.
 
I just moved into a new condo building that I'm renting from the owner. The move-in costs were $150+$300 damage deposit, which I completed last Friday.

CLIFF's: Going to be fined $750 by HOA for bringing in a couch with no permission to condo building, want to fight/appeal it.

They may try to hold the deposit(s) if you don't pay the fine.
 
I think the only reason they want to ok it first is so if you damage something while moving it they know its you? cant think of any other reason besides maybe having a giant moving van outside being a issue. Glad i dont have HOA.. I konw there was a news article on HOA trying to sue a guy for not parking his pickup truck in his driveway he won the lawsuit.
 
How could they possibly put that against his credit score? His agreement was with the owner, not the HOA. The HOA probably has none of his personal info.

I'm sure there's a way for it to go from HOA to lease owner back to me.
 
Any other subject and all of ATOT would being pissing on you because you shouldn't have signed the agreement if didn't want to follow it. Always find it funny that HOA's manage to be the exception.
 
The leasing company actually never sent me an HOA agreement with the terms.

Then the fault lies with the owner. He should have made you aware of the rules. If the HOA has an issue with you not paying, they will take it up with the actual owner as you have nothing to do with the HOA. They may make him pay the 750 but if the owner goes after you for that amount then I would tell him to take you to court and evict you.
 
No he didn't. It was some other guy they caught. And the other guy lied and gave Syringer's unit number.

Video/photographic evidence? It was some other guy.

Ha, I want it to be like Gattaca, where I have someone else come to the meeting and claim they're me..and it was a girl.

Politely ask the board to waive the fee. If they fail to do so. Never mention it again and never pay the fine. As others have said the homeowner is ultimately responsible. They can't do squat to you.


Friendly warning to all the HOA haters out there: Never pay your HOA with a personal check. We make a copy of your check in case we ever have to raid your bank account as part of a judgment.
