How will the friend testify in court exactly? She is not a witness. If she claims to be a witness then she would be incriminating herself because she sat by and watched. Otherwise the only thing she can do is offer hearsay which is not really admissible.

Yeah I'm not leaving anything out at all. They tried contacting me again 6 months ago, but I didn't reply. And now out of nowhere this morning I have a missed call in 1:37 am and 5 unread text messages from a number not in my phonebook. Trust me, I wouldn't leave anything out if I'm concerned about what might happen to me, thats why I give the full story so I can see what I might be facing.

As far as everything else, I really appreciate the time to explain everything to me, and I feel alot better. Unless their rich parents decide to really throw alot of money away. And I'm not going to contact her or her friend.

they're both the same basically - except that slander is spoken and libel is written. Basically it's spreading falsities about a person that have a tendency to damage their reputation in the community.

You're not going to counter-sue because you're not going to get sued.

Post these new 5 text messages or PM them to me. I'm curious.

Slander and libel must both be communicated to a third party to exist. Those don't exist here.

I agree, they're effing with you in an attempt to make themselves feel good or to get you to do something stupid. You aren't going to get sued.

However, the pessimist in me says "Always CYA". Save the texts. If they do lawyer-up and progress things, you would probably be able to make a passable case at harassment and/or intentional infliction of emotional distress. Assuming there would be civil charges only against you (what prosecutor in their right mind would pursue criminal charges in the circumstances you've described?), a decent attorney could get them dropped by threatening counter-suit. The plaintiff against you would have to consent to airing all of her dirty laundry, which I bet she doesn't want to do.
