Any lawyers in the house? I need some advice....

My father-in-law did the same thing you did. He now has a warrant out for his arrest. He says he has every intention of paying the second he gets the money, the judge doesn't care, he will serve a minimum of 30 days whether he pays or not. Can't buy your way out of contempt of court.

My advice, pay her and pay her now.

What does him being negligent has to do with marriage?

Buck, it is up to the judge whether you will be held in contempt of court, which most likely he/she will. It is highly unlikely you will do any time. Be prepeared to spend more money in court costs and your ex's attorney fees.

Not him being negligent, but him having to deal with this, period. The crazy ex-wife, the threats, the lawyers.
 
Lets preface this with the obligatory "I'm not a lawyer, heck, I don't even play one on TV" 🙂

Bottom line, you could be held in contempt, but that is highly unlikely, considering that 1. you've made at least a partial payment, 2. a judge will not hold you in contempt if you can show that you simply have not been able to pay the full amount, and 3. jail terms are virtually unheard of with regard to debt.

Your wife's lawyer, if he does anything at all, can file a motion with the court to compell payment, possibly asking for the court to hold you in contempt if you do not pay up. The court will not hold you in contempt, but your wife could potentially get your wages garnished or have some of your assets taken to recover her court ordered $$$.

You should be OK, but make sure you follow through with the remainder of the required payment, otherwise you will get in trouble later on.

I am thinking that moving in with my girlfriend kind of set her off. I am talking to the bank today about a loan to get the remainder taken care of.

Marriage isnt a bad thing at all, i really just wish i wouldnt have done it so young. I did it for the wrong reasons and didnt think it through at all....
